This pollutant is being considered for placement on the section 303(d) list under section 3.3 of the Listing Policy. Under section 3.3 a single line of evidence is necessary to assess listing status.

Two lines of evidence are available in the administrative record to assess this pollutant. Neither of the samples exceeds the water quality objective.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfy the data quality requirements of section 6.1.4 of the Policy.
2. The data used do not satisfy the data quantity requirements of section 6.1.5 of the Policy in that only one sample per year is available.
3. Neither of two samples exceeded the water quality objective and this does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy. However, the minimum sample number requirements of Table 3.2 were not met.

Two lines of evidence are available in the administrative record to assess this pollutant. Neither of the samples exceeds the California Toxics Rule aquatic life standards. Both of the samples exceed the California Maximum Contaminant Level (MCL). Although only one sample per year is available, the springs are from a groundwater source and water quality is expected to be more constant over time than the quality of a lake or stream. Listing is being recommended because the springs are an existing source of drinking water.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

Water Quality Objective/Criterion: The applicable U.S. Environmental Protection Agency freshwater aquatic life criteria are as follows. For beryllium, the acute criterion is 130 ug/L and the chronic criterion is 5.3 ug/L. For iron, the 4- day average criterion is 1000 ug/L. For thallium, the acute Lowest Observed Effect Level (LOEL) criterion is 1400 ug/L, and the chronic LOEL criterion is 40 ug/L. (An "Other" criterion for thallium is 20 ug/L.) The California Toxics Rule (CTR) aquatic life standards for lead and silver are dependent on hardness. At the reported hardness values (123 and 126 mg/L CaCO3) the CTR standards are as follows. For lead, the acute standards are 84.05 and 86.67 ug/L. The chronic standards are 3.28 and 3..38 ug/L. For silver, the standard is 4.93 and 4.13 ug/L.

Spatial Representation: One station, Mesquite Spring (in Death Valley National Park, near Scotty¿s Castle), was sampled.
Temporal Representation: Two field measurements and two laboratory measurements of pH were taken in 2002 and 2003.
Environmental Conditions: The Mesquite Springs are within the Stovepipe Wells Hydrologic Subarea of the Amargosa Hydrologic Unit (HU No. 609.11). They supply drinking water to a campground. No site-specific water quality objectives apply to the springs. Chemical and radioactive constituents, including the salts that contribute to high specific conductance levels, come from natural sources. The Mesquite Springs are designated for both the Warm Freshwater Habitat and Cold Freshwater Habitat beneficial uses, and for the Rare, Threatened or Endangered Species Use.

Data Used to Assess Water Quality: The U.S. Geological Survey sampled Mesquite Springs under the Region 6 SWAMP program. Two field pH measurements were both 7.9 units; two laboratory measurements were 8.1 and 7.9 units. Sample numbers were too small for use with the Listing Policy's binomial model, and were also too small to define normal pH levels or to detect change.
