Weight of Evidence: This pollutant is being considered for removal from the section 303(d) list under section 4.3 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.

Eleven lines of evidence are available in the administrative record to assess this pollutant.

A 19% exceedance percentage was used for water quality monitoring conducted between April 01 through October 31 (summer months) only. Section 4.3 of the Listing Policy does not describe the use of a more stringent exceedance percentage for summer only beach bacteria monitoring, though one is inferred. As such the referenced data set was analyzed in two portions and described in two separate LOEs due to differing sampling time frames.

This waterbody pollutant combination was erroneous described in 2006 as being addressed by a USEPA approved TMDL. Promenade Park Beach was not addressed in the Santa Monica Bay Bacteria TMDLs or listed in Basin Plan Amendments 2002-004 and 2002-022.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segment.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. 31 of 307 samples, sampled year-round, from monitoring station VC14000 exceeded the updated Basin Plan single sample water quality objectives, 9 of 49 samples exceeded the geometric mean water quality objectives for indicator bacteria, and this exceeds the allowable frequency listed in Table 4.2 of the Listing Policy for geometric means.
4. 21 of 191 samples, sampled year-round, from monitoring station VC15000 exceeded the single sample objectives, 1 of 22 samples exceeded the geometric mean objectives for indicator bacteria, and this does not exceed the allowable frequency listed in Table 4.2 of the Listing Policy.
5. 4 of 64 samples from monitoring station VC15000 exceeded the single sample objectives for indicator bacteria, and this does not exceed the allowable frequency for monitoring in the summer months only. 1 of 14 samples exceeded the geometric mean water quality objectives and this sample size is insufficient to determine with the power and confidence of the Listing Policy if standards are met. A minimum of 26 samples in needed for application of table 4.2, utilizing a 19% exceedance percentage.
6. 24 of 195 samples, sampled year-round, from monitoring station VC16000 exceeded the single sample objectives, 2 of 22 samples exceeded the geometric mean objectives for indicator bacteria, and this does not exceed the allowable frequency listed in Table 4.2 of the Listing Policy.
7. 4 of 64 samples from monitoring station VC16000 exceeded the single sample objectives for indicator bacteria, and this does not exceed the allowable frequency based on monitoring in the summer months only. 0 of 14 samples exceeded the geometric mean objectives and this sample size is insufficient to determine if standards are met.
8. 29 of 245 samples, sampled year-round, from monitoring station VC17000 exceeded the single sample objectives, 3 of 32 samples exceeded the geometric mean objectives for indicator bacteria, and this does not exceed the allowable frequency listed in Table 4.2 of the Listing Policy.
9. 2 of 31 samples from monitoring station VC17000 exceeded the single sample objectives for indicator bacteria, and this does not exceed the allowable frequency based on monitoring in the summer months only. 1 of 7 samples exceeded the geometric mean objectives and this sample size is insufficient to determine if standards are met.
10. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.
 
RWQCB Board Decision / Staff Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the Water Quality Limited Segments Being Addressed category of the section 303(d) list and be place on the Water Quality Limited Segments Requiring a TMDL category of the section 303(d) list because applicable water quality standards for the pollutant are being exceeded and a TMDL has not been approved by USEPA to address this water segment-pollutant combination.

Spatial Representation: The Ventura County Environmental Health Division conducted sampling at Promenade Park Beach at beach monitoring station VC16000, located south of the drain at the end of Oak Street (Lat: 34.27531, Long: -119.29474).
Temporal Representation: Grab samples were taken and analyzed on a weekly basis from April 2005 to October 2006 in the summer months of April to October.

Data Used to Assess Water Quality: 10 out of 96 samples exceeded the Basin Plan single sample water quality objectives for indicator bacteria in marine water and two out of 22 samples exceeded the Basin Plan geometric mean water quality objectives. Water quality samples were taken and analyzed for indicator bacteria consistent with California Code of Regulations Title 17, sections 7958-7961 and related guidance issued by California Department of Public Health .

Water Quality Objective/Criterion: The Basin Plan bacteria objectives state that to protect water contact recreation in marine waters individual samples shall not exceed the following limits: the total coliform density shall not exceed 10000/100 ml; the fecal coliform density shall not exceed 400/100 ml; the enterococcus density shall not exceed 104/100 ml; and the total coliform density shall not exceed 1,000/100 ml, if the ratio of fecal-to-total coliform exceeds 0.1 as single samples. The bacteria objectives also establish that the geometric means of individual samples shall not exceed the following limits: the total coliform density shall not exceed 1000/100 ml, the fecal coliform density shall not exceed 200/100 ml, and the enterococcus density shall not exceed 35/100 ml, as a geometric mean. The bacteria objectives are found in Attachment A of Regional Board Resolution No. 2001-018.
