Weight of Evidence:	This pollutant is being considered for removal from the section 303(d) list under section 4.3 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. Six lines of evidence are available in the administrative record to assess this pollutant. Data from line of evidence 3528, 3529, 3530, 3531, will not be considered in this decision due the newer lines of evidence including all the data listed from the older lines of evidence. A 19% exceedance percentage was used for water quality monitoring conducted between April 01 through October 31 only. Section 4.3 of the Listing Policy does not specifically describe the use of more stringent exceedance percentage for summer only beach bacteria monitoring, though one is inferred. As such the referenced data set was analyzed in two portions and described in two separate LOEs due to differing sampling time frames. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. 18 of 279 samples, sampled year-round, from monitoring station VC42000 exceeded the updated Basin Plan single sample water quality objectives, three of 64 samples exceeded the geometric mean water quality objective for indicator bacteria, and this does not exceed the allowable frequency listed in Table 4.2 of the Listing Policy. 4. One of 62 samples from monitoring station VC42000 exceeded the single sample water quality objective for indicator bacteria, and this does not exceed the allowable frequency of 19% inferred in Section 4.3 of the Listing Policy for water quality monitoring conducted between April 01 through October 31 only. One of 14 samples exceeded the geometric mean water quality objective and this sample size is insufficient to determine with the power and confidence of the List Policy if standard are met. A minimum of 26 samples in needed for application of table 4.2, utilizing a 19% exceedance percentage. 5. 35 of 278 samples, sampled year-round, from monitoring station VC43000 exceeded the updated Basin Plan single sample water quality objectives, 12 of 64 samples exceeded the geometric mean for indicator bacteria, and this exceeds the allowable frequency listed in Table 4.2 of the Listing Policy for geometric means. 6. Six of 59 samples from monitoring station VC43000 exceeded the single sample water quality objective for indicator bacteria, and this does not exceed the allowable frequency for water quality monitoring conducted between April 01 through October 31 only. Zero of 14 samples exceeded the geometric mean water quality objective and this sample size is insufficient to determine with the power and confidence of the Listing Policy if standards are met. 7. Three of 255 samples, sampled year-round, from monitoring station VC44000 exceeded the single sample water quality objectives, one of 64 samples exceeded the geometric mean water quality objective for indicator bacteria, and this does not exceed the allowable frequency listed in Table 4.2 of the Listing Policy. 8. One of 53 samples from monitoring station VC44000 exceeded the single sample water quality objective for indicator bacteria, and this does not exceed the allowable frequency for water quality monitoring conducted between April 01 through October 31 only. Zero of 14 samples exceeded the geometric mean water quality objective and this sample size is insufficient to determine with the power and confidence of the Listing Policy if standards are met. 9. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

RWQCB Board Decision / Staff Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

Spatial Representation:	The Ventura County Environmental Health Division conducted sampling at Ormond Beach at beach monitoring station VC42000, located 25 yards south of J Street drain (Lat: 34.13898, Long: -119.18923).
Temporal Representation:	Grab samples were taken and analyzed on a weekly basis from April 2005 to October 2006 in the summer months of April to October.
