Regional Board Conclusion: This pollutant is being considered for removal on the section 303(d) list under sections 2.2 and 4.2 of the Listing Policy. Under 2.2 of the Policy, a minimum of one line of evidence is needed to assess listing status.

Three lines of evidence are available in the administrative record to assess this pollutant.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list. There is sufficient justification to place it in the Being Addressed portion of the 303(d) list because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Thirty one of thirty one samples exceeded the objective and these exceed the allowable frequency listed in Table 4.2 of the Listing Policy.
4. The Indian Creek Reservoir TMDL has been approved by the Lahontan Water Board July 24, 2002 and approved by USEPA on July 1, 2003.
5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Evaluation Guideline: The modified OEHHA Fish Contaminant Goal for total chlordane in fish tissue is 3.9 ppb. This screening level assumes an average body weight of 70 kg and a consumption rate of 32 g/day for a 30 year exposure over a 70-year lifetime. This constituent is a carcinogen therefore the risk level is set to one in a million. A cooking reduction factor of 1 is applied for skin-off fillets.

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.11 of the Listing Policy. Under this section when all other listing factors do not result in the listing of a water segment but information indicates non-attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates the water quality standard is not attained. If the weight of evidence indicates non-attainment, the water segment shall be placed on the section 303(d) list.

Two lines of evidence, are available in the administrative record to assess mercury concentrations in fish fillets. LOE # 45420 average fish tissue samples collected at a single site on the same day according to section 6.1.5 of the Listing Policy. Zero exceedances of one sample is not sufficient to support a listing based upon Section 3.1 of the Listing Policy.

Though the samples were collected from a single location on a single day, fish move throughout a lake and accumulate mercury in tissue over time. Therefore, spatial and temporal independence does not apply. A second line of evidence (LOE # 47541) presents total wet-weight mercury concentrations from two composites of rainbow trout (5 fish per composite). Assessing these data according to Table 3.1 would be sufficient to not support a listing.

Based on the readily available data and information, the weight of evidence indicates there is sufficient justification for not placing this water segment-pollutant combination on the Section 303(d) list.


This conclusion is based on the staff findings that:

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. The Lahontan Basin Plan's narrative pH objective (Chapter 3) is an antidegradation-based objective that requires that changes in normal ambient pH levels shall not exceed 0.5 pH units for waterbodies designated for the COLD or WARM beneficial uses. (A pH range of 6.5 to 8.5 units applies to "all other waters.") Though the 2012 LOE for pH (LOE ID #33847) indicates 125 out of 275 samples exceed the water quality objective, we can not determine that these are true exceedances since the normal ambient pH of this waterbody has not been established. Listing Policy section 3.10 contains direction for assessment based on trends in water quality. Even though there are 275 samples collected over a 31 year period, no data analysis has been done as of yet to determine baseline conditions (including diel, seasonal, annual and interannual variations).

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status.

One line of evidence is available in the administrative record to assess this pollutant. Nineteen of the 95 samples fell below 7.0 mg/L dissolved oxygen (DO) which violated the water quality objective; however, reporting from STPUD several years after installation of a hypolimnetic oxygenation system indicates DO levels are improving as expected.

Additionally, in 2003, USEPA approved a TMDL for phosphorus at Indian Creek Reservoir. As part of that TMDL, there are target concentrations for dissolved oxygen that must be met at an interim and long term value. The interim target value of a 30 day mean 6.5 mg/L, 7 day mean minimum of 5.0 mg/L, or a one day minimum of 4.0 mg/L must be met by 2013, To account for this target, the responsible party, the South Tahoe Public Utility District, acquired a grant (CWA 319(h) non-point source grant #06-244-556-0) to implement a hypolimnetic system in the reservoir. The hypolimnetic system was installed in 2007 and R6 staff managed the grant. STPUD consistently monitors the water column for DO once a month and voluntarily provides R6 staff with an annual monitoring report to track levels of DO at the reservoir. At the deepest sampling site on the reservoir, DO concentrations have significantly improved and are almost consistently meeting the one day minimum of 4.0 mg/L.

The current phosphorus TMDL includes target values for DO to meet the requirements of the TMDL and STPUD has taken measurable efforts by installing a hypolimnetic system to improve DO in the reservoir. These implementation tactics align with the same tools that would be required for a separate TMDL specific to DO.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
