Regional Board Conclusion: | No new data were assessed. However, a TMDL has been approved by US EPA since the 2010 assessment cycle.
This pollutant is being considered for removal from the section 303(d) list under section 4.1 and 4.3 of the Listing Policy. Under section 4.3 a single line of evidence is necessary to assess listing status. Note the pollutant name was changed from pathogens to fecal coliform in the 2014 assessment cycle because the only available supporting data is for fecal coliform. Two lines of evidence are available in the administrative record to assess this pollutant. Although the original data used to place this waterbody on the Section 303(d) list in not included in the assessment database, recent data indicated impairment. Six of 22 samples exceed the water quality objective for Water Contact Recreation. Zero of the 22 samples exceeds the Non-Contact Recreation objective, so this beneficial use is fully supported. This water segment/pollutant combination is being addressed in the TMDL for the San Lorenzo River Watershed Pathogen TMDL which sets TMDL targets for fecal coliform in Lompico Creek. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. In accordance with section 2.2 of the Policy, there is sufficient justification to place it in the Being Addressed portion of the CWA 303(d) List because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Six of 22 samples exceed the water quality objective for Water Contact Recreation and this exceeds the allowable frequency listed in Table 3.2 of the Listing Policy. 4. The San Lorenzo River Watershed Pathogen TMDL has been approved by USEPA on July 20, 2011. 5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |

Regional Board Conclusion: | This pollutant is being considered for removal on the CWA section 303(d) List under sections 2.2 and 4.1 of the Listing Policy. Under 4.1 of the Policy, a minimum of one line of evidence is needed to assess listing status.
The pollutant name has been changed from Nutrients to Nitrate to be consistent with the TMDL for this water segment and pollutant. Seven LOEs are available in the administrative record to assess this pollutant. The Municipal and Domestic Supply use (i.e. drinking water) is assessed using both the Central Coast Basin Plan water quality objective for Municipal and Domestic Supply (10 mg/L as N) and the Lompico Creek TMDL numeric target for drinking water (1.5 mg/L as N). The TMDL numeric target meets the criteria of the Listing Policy (Section 6.1.3) as it is applicable to the beneficial use, protective of the beneficial use, linked to the pollutant under consideration, scientifically based and peer reviewed, well described and identified a range above which negative impacts will occur. Two LOEs summarize the data compared to the TMDL numeric target for Lompico Creek (LOEs 26447 and 79038). Thirteen of the 100 samples exceed the TMDL target. The beneficial use support rating for these LOEs is set at Not Supporting. Note, only data collected since 1997 were compared to the TMDL target and this is why the sample count in this LOE differs from the other LOEs. Two additional LOEs summarize data compared to the water quality objective for Municipal and Domestic Supply (LOEs 18642 and 54663) and zero of the 159 samples exceed this objective. The beneficial use support rating for these LOEs is set at Fully Supporting. Two LOEs summarize data compared to the water quality objective for Agricultural Supply (LOEs 18647 and 54664) and zero of the 159 samples exceed this objective. The beneficial use support rating for these LOEs is set at Fully Supporting. One LOE is used as a place holder for the original decision to add Lompico Creek to the 303(d) list. However this decision was made prior to the creation of this assessment data base and there is no data or information supporting this LOE. The beneficial use support rating for this LOE is set at Insufficient Information. One of the 151 samples exceed the Evaluation Guideline (Sigler et al., 1984) applied to protect for aquatic life beneficial uses. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3.
