Regional Board Conclusion:	No new data were assessed. However, a TMDL has been approved by US EPA since the 2010 assessment cycle. Note the pollutant name has been changed from Pathogens to Indicator Bacteria. This pollutant is being considered for removal from the section 303(d) list under section 4.2 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. Seven lines of evidence are available in the administrative record to assess this pollutant. One LOE (#3934) is a placeholder for the original listing. In addition, 2 LOEs summarize E. coli data collected in Carbonera Creek. Two of the 7 samples exceed the Water Contact Recreation water quality objective and none of the 7 samples exceed the Non-Contact Recreation water quality objective. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. There is sufficient justification to place it in the Being Addressed portion of the CWA 303(d) List because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Two of 7 samples exceeded Water Contact Recreation Objective and this is an insufficient number of samples to consider delisting; a minimum of 28 samples are required. 4. The San Lorenzo River Watershed Pathogen TMDL has been approved by the USEPA on July 20, 2011. 5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Conclusion:	This pollutant is being considered for removal from the CWA section 303(d) List under section 4.9 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant. The initial decision to place this water body segment-pollutant combination on the 303(d) list was made prior to 2006 and associated data and documentation are not held in an assessment database. As a result, there are no data associated with the LOE that is a placeholder for the original decision to add this water body segment-pollutant combination to the List. However, recent physical habitat and benthic invertebrate community data have been collected and are summarized in one LOE. Both of the samples have degraded biological community composition (EPT taxa richness less than 12), however, neither of the samples are associated with more than 40 percent cover of deposited fine and sand sized sediment on the streambed. There are an insufficient number of samples to determine beneficial use support. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. None of the have more than 40 percent cover of deposited fine and sand sized sediment on the streambed and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

Water Board staff evaluated sediment grain size and EPT taxa data that was collected following the SWAMP physical habitat and benthic invertebrate protocol from Carbonera Creek. At zero of the two stations, deposited fine and sand (FS) sediments on the stream bed were greater than 40% cover. However, both samples had less than 12 EPT taxa (EPT richness), the threshold for indicating degraded biological diversity and community composition at these locations.

Regional Board Conclusion:	This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. Carbonera Creek provides habitat for coho salmon and steelhead trout, which are listed as a threatened species under the federal Endangered Species Act. Four lines of evidence are available in the administrative record to assess this pollutant. Three LOEs summarize 114 grab samples and 1 of these samples exceeds the evaluation guideline (optimum range for steelhead, Moyle, 1976) used to interpret the narrative water quality objective. LOE 53965 summarizes 55 days of continuous temperature measurements which are evaluated by calculating maximum weekly maximum temperature (MWMT). The MWMTs exceed the evaluation guideline applied to long term continuous temperature data (MWMT for Central Coast Coho, NOAA, 2012) used to interpret the narrative water quality objective. For reference, the MWMT was exceeded 16 days in a row but the MWMT did not exceeded 18 degrees in Carbonera Creek during the period of measurement. Eighteen degrees is the EPA temperature criterion for non-core salmon and trout. However, for this assessment the 16 degree MWMT is used as it is more appropriate and protective for this waterbody. One of the 114 grab samples and the single MWMT calculated from long term deployment of continuous temperature logger data did exceed the relevant evaluation guideline used to interpret the narrative water quality objective for temperature and aquatic life protection. Therefore, the water temperature in Carbonera creek is within the tolerance range for steelhead trout (that use is supported) however, there is not enough data and information to determine a use rating for water temperature when evaluated using the MWMT threshold. A minimum of 26 samples is needed to determine if a beneficial use is supported and a minimum of two exceedances is needed to determine if beneficial uses are not supported using table 3.2. Therefore, the use support rating is set to 'insufficient information'. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. One of the 114 grab samples and the single MWMT calculated from long term deployment of continuous temperature logger data did exceed the relevant evaluation guidelines but, this does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy. 4. Water temperature data submitted by the Lompico Watershed Conservancy from the summer months of 2005 showed that the maximum weekly maximum temperature (MWMT) exceeded 16 degrees Celsius because of co-existance with Coho historically in this watershed . The MWMT is an average for the year and therefore, for the purpose of this assessment is counted as a single sample and exceedance. These data were compiled by Donald Alley (fisheries biologist).

For reference, the MWMT was exceeded 16 days in a row but the MWMT did not exceeded 18 degrees in Carbonera Creek during the period of measurement. Eighteen degrees is the EPA temperature criterion for non-core salmon and trout. However, for this assessment the 16 degree MWMT is used as it is more appropriate and protective for this waterbody.

Per the Central Coast Coho Salmon Recovery Plan, Vol III, pages 55-56 (NOAA, 2012) population level temperature rating of 16 degrees C (temperature expressed as maximum weekly maximum temperature or MWMT) are protective of juvenile coho during rearing season (summer). This threshold is protective of chronic exposure to elevated water temperatures which can result decline and absence of juvenile coho in habitats. This is also consistent with the 'U.S. EPA Region 10 Guidance for Pacific Northwest State and Tribal Temperature Water Quality Standards' (USEPA 2003), in which the U.S. EPA recommends a criterion for the protection of moderate to high density summertime salmon and trout juvenile rearing (i.e., core juvenile rearing) of a maximum weekly maximum temperature (MWMT) of 16 degrees C. The MWMT is also known as the maximum 7-day average of daily maximums (7DADM). The 16 degrees C MWMT criterion is recommended to (1) safely protect juvenile salmon and trout from lethal temperatures; (2) provide upper optimal conditions for juvenile growth under limited food during the period of summer maximum temperatures and optimal temperatures for other times of the growth season; (3) avoid temperatures where juvenile salmon and trout are at a competitive disadvantage with other fish; (4) protect against temperature induced elevated disease rates; and (5) provide temperatures that studies show juvenile salmon and trout prefer and are found in high densities. Both the CDFG and NOAA strongly support the use of the USEPA temperature guidance for the purposes of water quality assessment in California. These criteria have been adopted by both Oregon and Washington state and used for 303(d) Listing and TMDL development by the North Coast Region Water Quality Control Board. Its use in other geographic settings is appropriate as it has been recognized that salmonid stocks do not tend to vary much in their life history thermal needs, regardless of their geographic location. There is not enough significant genetic variation among stocks or among species of salmonids to warrant geographically specific water temperature standards.

Regional Board Conclusion:	No new data were assessed. This pollutant is being considered for removal from the section 303(d) list under section 4.1 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. A TMDL was approved by USEPA on January 14, 2003. The RWQCB is tracking the implementation of the TMDL through the Nitrate Management Plan being implemented by Santa Cruz County. Eight lines of evidence (LOEs) are available in the administrative record to assess this pollutant. One LOE (LOE #1845) is a placeholder that does not contain data or information. Staff is unable to reconstruct the original data used to place this water segment-pollutant combination on the section 303(d) list. Zero of the 86 samples exceed the Municipal and Domestic Supply water quality objective and zero of the 86 samples exceed the Agricultural Supply water quality objective. However, as summarized in LOE 26449, Fifty-four of 72 samples exceed the numeric target established by the TMDL (Resolution #00-003, adopting the TMDL for nitrate in the San Lorenzo River Watershed) established to protect the Municipal and Domestic Supply. The numeric target meets the criteria of the Listing Policy (Section 6.1.3) as it is applicable to the beneficial use, protective of the beneficial use, linked to the pollutant under consideration, scientifically based and peer reviewed, well described and identified a range above which negative impacts will occur. There is sufficient justification to place it in the Being Addressed portion of the CWA 303(d) List because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Fifty-four of 72 samples exceed the Evaluation Guideline (the numeric target from the TMDL, 2000) and this exceeds the allowable frequency in Table 4.1 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

Water Quality Objective/Criterion:

Waters shall not contain concentrations of chemical constituents in amounts which adversely affect the agricultural beneficial use. Interpretation of adverse effect shall be as derived from the University of California Agricultural Extension Service guidelines provided in Table 3-3 (Central Coast Waterboard Basin Plan, Chapter III, Section II.A.2 Objectives for all Inland and Surface Waters, Enclosed Bays and Estuaries). In Table 3-3 of the Basin Plan (page III-8), water quality guidelines state that severe problems may occur when pH is greater than 8.4 or less than 6.5 in irrigation supply water.
