Regional Board Conclusion: The shellfish beneficial use no longer applies to this water segment.

The Central Coast Water Board approved resolution 2006-0025 on March 24, 2006 amending the Water Quality Control Plan for the Central Coast Basin to remove the Shellfish Harvesting beneficial use from Watsonville Slough and tributaries. This was approved by the California Office of Administrative Law on November 20, 2006 and was approved by the USEPA on July 19, 2007.

This pollutant is being considered for placement on the section 303(d) list under sections 2.1 and 3.2 of the Listing Policy.

One line of evidence is available in the administrative record to assess this pollutant. Based on section 3.2 the site exceeded numeric objectives for conventional pollutants. According to the binomial distribution, waters shall be placed on the section 303(d) list if the number of measured exceedances supports rejection of the null hypothesis as presented in Table 3.2.

Nine of 12 samples exceed the Evaluation Guideline (Sigler et al., 1984) applied to protect for aquatic life beneficial uses. This supports rejection of the null hypothesis. However, at this time staff are unaware of any documentation of steelhead populations in Gallighan Slough. Therefore this Evaluation Guideline is not relevant for this waterbody.

Based on the readily available data and information, there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. At this time staff are unaware of any documentation of steelhead populations in Gallighan Slough. Therefore this Evaluation Guideline is not relevant for this waterbody.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

A TMDL has been approved by USEPA (July 19, 2007) for pathogens in Watsonville Slough and four of its tributaries (specifically Gallighan Slough).

This pollutant is being considered for placement on the section 303(d) list under section 4.3 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.

Four lines of evidence are available in the administrative record to assess this pollutant. Four of the 9 samples, tested for E. coli) and 3 of the 9 samples, tested for Fecal Coliform, exceed the water quality objective for Water Contact Recreation. A minimum o f 26 samples are required to determine if water quality standards are being met.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for placing this water segment-pollutant combination on the section 303(d) list. In accordance with section 2.2 of the Policy, there is sufficient justification to place it in the Being Addressed portion of the CWA 303(d) List because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Four of the 9 samples, tested for E. coli) and 3 of the 9 samples, tested for Fecal Coliform, exceed the water quality objective for Water Contact Recreation and these exceed the allowable frequency calculated from the equation in Table 4.2 of the Listing Policy. However, the sample size is insufficient to determine with the power and confidence of the Listing Policy if water quality standards are met or exceeded.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.
