Regional Board Conclusion: | This pollutant is being considered for removal from the section 303(d) list under section 4.1 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.
Two lines of evidence are available in the administrative record to assess pollutant. Ten of samples exceed the water quality objective. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Ten of 59 samples 4-day maximum criterion for dissolved copper and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met. |

Regional Board Conclusion: | This pollutant is being considered for removal from the CWA section 303(d) list under section 4.1 of the Listing Policy. Under section 4.1 a single line of evidence is necessary to assess listing status.
Two lines of evidence are available in the administrative record to assess this pollutant. 38 of the 50 fish tissue sample results exceed the evaluation guideline for the COMM beneficial use. LOE 22582 was not used in the final listing decision because of a criterion change. The data in LOE 22582 were reassessed in LOE 95429 with the new criterion. LOE 95429 was used in the final listing decision. Based on the readily available data and information, the weight of evidence indicates that there is insufficient justification in favor of removing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. 38 of the 50 fish tissue sample results exceed the evaluation guideline for the COMM beneficial use and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
Regional Board Decision Recommendation: | After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem. |

Regional Board Conclusion: | This pollutant is being considered for delisting under sections 4.1 of the Listing Policy. Under section 4.1 a single line of evidence is necessary to assess listing status. Data is available from three lines of evidence for this pollutant.
Based on the readily available data and information, the weight of evidence indicates that there is not sufficient justification for delisting this water segment-pollution combination from the section 303(d) list. The recommendation is based on staff findings that support the original decision to list this water body-pollutant combination on the 303(d) list is documented only by a placeholder line of evidence that contains no specificdata or information. One water sample result exceeded the California Toxics Rule for dissolved zinc CMC (for Cold Freshwater Habitat), and is also based on staff findings that 0 of 2 available total zinc concentrations exceeded the Department of Public Health Primary MCL for Municipal & Domestic Supply, and a minimum of 28 samples is needed for consideration of delisting under section 4.1. |

Regional Board Conclusion: | This pollutant is being considered for placement on the CWA section 303(d) List under section 3.1 of the Listing Policy. Under section 3.1 a least one line of evidence is necessary to assess listing status.
One line of evidence is available in the administrative record to assess this pollutant. The single sample result does not exceed the evaluation guideline. Based on the readily available data and information, the weight of evidence indicates that there is not sufficient justification to place this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Zero of one samples exceeded the evaluation guideline and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of sixteen samples is needed to determine if a beneficial use is fully supported using table 3.1. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
Regional Board Decision Recommendation: | After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list. The readily available data and information is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. |

Regional Board Conclusion: | This pollutant is being considered for placement on the CWA section 303(d) List under section 3.1 of the Listing Policy. Under section 3.1, a single line of evidence is necessary to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant. Two water samples did not exceed the water quality objectives for eithr the COLD or MUN beneficial uses. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List.
This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Neither of two water sample result exceed the water quality objectives for COLD or MUN, and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is fully supported using table 3.1. |

Under section 3.1 a single line of evidence is necessary to assess listing status.
Two lines of evidence are available in the administrative record to assess this pollutant. Zero of one sample exceeds the evaluation guideline for COLD and zero of one sample exceeds the evaluation guideline for COMM. 3. Zero of one sample exceeds the evaluation guideline for COLD and zero of one sample exceeds the evaluation guideline for COMM. This sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is fully supported using table 3.1. |

Under section 3.1 a single line(s) of evidence are necessary to assess listing status.
Two lines of evidence are available in the administrative record to assess this pollutant. Zero of one sample exceed the evaluation guideline for COLD. Zero of one sample exceed the evaluation guideline for COMM. 3. Zero of one sample exceed the evaluation guideline for COLD. Zero of one sample exceed the evaluation guideline for COMM. This sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is fully supported using table 3.1. |

The single sample result does not exceed the evaluation guidelines. 3. The single sample result does not exceed the evaluation guidelines, and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is fully supported using table 3.1. |

Impairment from Pollutant or Pollution: | Pollutant |
Regional Board Conclusion: | This pollutant is being considered for listing under sections 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status. Data is available from three lines of evidence for this pollutant.
Based on the readily available data and information, the weight of evidence indicates that there is not sufficient justification for placing this water segment-pollution combination on the section 303(d) list. The recommendation is based on staff findings that the single available water sample result exceeded the water quality objectives for the Cold Freshwater Habitat (COLD) and the Municipal and Domestic Supply (MUN). In addition, the single composite fish tissue result does not exceed the evaluation guideline for the Commercial or recreational collection of fish, shellfish, or organisms (COMM) beneficial use. The available data does not exceed the allowable frequency using Table 3.1 of the Listing Policy. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
Regional Board Decision Recommendation: | After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because there is insufficient data to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. According to Table 3.1 of the Listing Policy, a minimum of 16 samples is required to determine the water quality beneficial use support rating. |

Regional Board Conclusion: | This pollutant is being considered for listing under sections 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. Data is available from 1 line of evidence for this pollutant. Based on the readily available data and information, the weight of evidence indicates that there is not sufficient justification for placing this water segment-pollution combination on the section 303(d) list. The recommendation is based on staff findings that 0 of 25 available concentrations exceeded the water quality objective and this does not exceed the allowable frequency using Table 3.2 of the Listing Policy. Table 3.2 of the listing policy recommends listing if a sample size of 25 has 6 or more samples that exceed the evaluation criteria. According to table 3.2, minimum of 26 samples is needed to determine, with the power and confidence of the Listing Policy, the applicable beneficial use rating.
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
Regional Board Decision Recommendation: | After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because applicable water quality standards are not being exceeded. |

Regional Board Conclusion: | This pollutant is being considered for placement on the CWA section 303(d) List under section 3.1 of the Listing Policy.
3. Zero of one sample exceed the evaluation guideline for COLD. Zero of one sample exceed the evaluation guideline for COMM. This sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is fully supported using table 3.1. |

The recommendation is based on staff findings that 1 of 25 available concentrations exceeded the water quality objective and this does not exceed the allowable frequency using Table 3.2 of the Listing Policy. Table 3.2 of the listing policy recommends listing if a sample size of 25 has 5 or more samples that exceed the evaluation criteria.
The data used satisfies the data quality requirements of section 6.1.4 of the Policy. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
Regional Board Decision Recommendation: | This is a decision previously approved by the State Water Resources Control Board and the USEPA. No new data were assessed by the Regional Board for the current cycle. The decision has not changed. |
