Regional Board Conclusion: This water body segment and pollutant combination was reconsidered for placement on the 303(d) list under section 3.1 of the Listing Policy. Under section 3.1, a single line of evidence is necessary to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant. The evidence indicates that chlorpyrifos concentrations have not been exceeding the applicable water quality standards and that the original listing decision was based on a flawed interpretation of sample results.
In the original listing, four of ten sample results were considered to be exceeding the chronic water quality criterion; however, three of these four exceedances were from samples with results below the quantitation limit and therefore should not have been included in the analysis under section 6.1.5.5 of the Listing Policy.
Based on the readily available data and information, the weight of evidence indicates this water segment-pollutant combination was originally assessed incorrectly and placed on the section 303(d) list in error. The correct sample and exceedances counts do not exceed the applicable water quality standards. Since this waterbody and pollutant combination was originally placed on the 303(d) list in error, this new (2014 Integrated Report cycle) decision is to remove it from the 303(d) list.
This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Ten water samples were collected from Ash Slough in 2005 and 2006, representing seven calculated 4-day concentrations and seven 1-hour concentrations. Three of the ten sample results could not be quantified with the power and confidence of the Listing Policy because the (estimated) results were below the reporting limits, but the reporting limits were greater than the criteria. One of the seven calculated 4-day average concentrations exceeded the 4-day average (chronic) criterion of 0.015 ug/L. One of the seven 1-hour average concentrations exceeded the 1-hour (acute) criterion of 0.025 ug/L, and this does not exceed the allowable frequency listed in Table 3.1 of the Listing Policy.
4. Neither of two calculated 1-hour average chlorpyrifos concentrations in samples collected from Ash Slough in 2009 and 2010 exceeded the 4-day average chlorpyrifos criterion. Neither of two calculated 4-day average chlorpyrifos concentrations in samples collected from Ash Slough in 2009 and 2010 exceeded the 4-day average chlorpyrifos criterion.
5. A total of one of 9 four-day average concentrations exceeded the 4-day average (chronic) criterion of 0.015 ug/L and this does not exceed the allowable frequency listed in Table 3.1 of the Listing Policy. A total of one of nine 1-hour average concentrations exceeded the 1-hour (acute) criterion of 0.025 ug/L, and this does not exceed the allowable frequency listed in Table 3.1 of the Listing Policy
5. Pursuant to section 3.1 of the Listing Policy, no additional data and information are available indicating that standards are being met.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that this water segment-pollutant combination was originally assessed incorrectly and placed on the section 303(d) list in error. The correct sample and exceedances counts do not exceed the applicable water quality standards. Since this waterbody and pollutant combination was originally placed on the 303(d) list in error, and the corrected exceedance frequency indicates chlorpyrifos concentrations are meeting water quality standards, this new (2014 Integrated Report cycle) decision is to remove it from the 303(d) list.
