Water Body Name: Iron Gate Reservoir
Water Body ID: CAL1053702320020720133707
Water Body Type: Lake & Reservoir

DECISION ID
102597
Region 1
Iron Gate Reservoir

Pollutant: Aldrin
Final Listing Decision: Do Not List on 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: New Decision
Revision Status Revised
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under section 3 of the Listing Policy. Under section 3 a single line of evidence are necessary to assess listing status.

One lines of evidence are available in the administrative record to assess this pollutant. None of the samples exceed the objective.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. None of the samples exceeded the objective and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is fully supported using table 3.1.
4. Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list. The readily available data and information is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating.

DECISION ID
78844
Region 1
Iron Gate Reservoir

Pollutant: Pesticides
Final Listing Decision: Do Not List on 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: Do Not List on 303(d) list (TMDL required list)(2016)
Revision Status Revised
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: The pollutant was considered for placement on the section 303(d) list in a previous assessment cycle.

No new information was reviewed for this current assessment cycle. Therefore, the previous conclusion remains unchanged, and is as follows:

These pollutants are being considered for placement on the Section 303(d) List under Section 3.1 of the Listing Policy. Under Section 3.1, a single line of evidence is necessary to assess listing status. Nine lines of evidence are available to assess protection of the cold freshwater habitat (COLD) beneficial use, Nine lines of evidence are available to assess protection of the warm freshwater habitat (WARM) beneficial use, and ten lines of evidence are available to assess protection of the commercial and sport fishing (COMM) beneficial use.

Per the Listing Policy, fish tissue data from LOEs 44759, 44777, and 44790 assessing the COMM beneficial use could not be evaluated because the laboratory data reporting limit(s) were above the objectives and therefore the results could not be quantified with the level of certainty required by the Listing Policy.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category (i.e., sufficient justification to not list). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy. (3) Zero of one fish tissue sample for each of the pesticides assessed exceed both the COLD and WARM objective. Zero of one fish tissue sample exceed the COMM objective for chlordane, endrin, hexachlorobenzene, Lindane/gamma Hexachlorocyclohexane, PCBs, Total DDT, and alpha-endosulfan. Zero of two fish tissue samples exceed the COMM objective for DDT. These sample sizes are insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (A) 16 samples, or (B) greater than or equal 2 exceedances of the objective with less than 16 samples is needed for application of Table 3.1. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation: This is a decision previously approved by the State Water Resources Control Board and the USEPA. No new data were assessed by the Regional Board for the current cycle. The decision has not changed.

Pollutant: Zinc
Final Listing Decision: Do Not List on 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: Do Not List on 303(d) list (TMDL required list)(2016)
Revision Status Revised
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a minimum of one line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant.

(3) Zero of nine samples exceed the evaluation guideline used to interpret the narrative toxicity objective, and this sample size is insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (A) 16 samples, or (B) greater than or equal 2 exceedances of the objective with less than 16 samples is needed for application of Table 3.1. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation: This region was not assessed this cycle. All decisions have been carried over from the previous cycle and remain the same.

Revision Status Revised
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under section 3.1 of the Listing Policy. Under section 3.1 a single line(s) of evidence are necessary to assess listing status.

Three line(s) of evidence are available in the administrative record to assess this pollutant.

3. None samples exceeded the objective and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating.

Pollutant: Mercury
Final Listing Decision: List on 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: List on 303(d) list (TMDL required list)(2016)
Revision Status Revised
Sources: A Source Unknown
Expected TMDL Completion Date: 2025
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under section 3.11 of the Listing Policy. Under this section when all other listing factors do not result in the listing of a water segment but information indicates non-attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates that water quality standard is not attained. If the weight of evidence indicates non-attainment, the water segment shall be placed on the CWA section 303(d) List.

LOE 31887 and LOE 47583 are replaced with LOE 133916.
LOE 44789 and LOE 47501 are replaced with LOE 132980.
LOEs 133916 and 132980 are reassessments of the same data according to new mercury objectives.

Four lines of evidence are available in the administrative record to assess mercury concentrations in fish fillets.

WILD beneficial use: LOE 133917 has one of one sample exceeding the mercury objective. LOE 132933 has one of one sample exceeding the mercury objective and the annual average is based on 14 fish.

COMM beneficial use: LOE 133916 has one of one sample exceeding the mercury objective. LOE 132980 has one of one sample exceeding the mercury objective and the annual average is based on 14 fish. Fish used in the COMM assessment are limited to lengths that are within Calif. Dept. of Fish and Wildlife legal size limits applicable to this waterbody.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. One of one samples exceed the objective for the WILD and COMM beneficial uses. The annual averages of the two exceeding composites are based on 14 fish and this is greater than the minimum eight or more individual fish are needed to determine non-attainment of the mercury objectives following section 3.11 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be placed on the section 303(d) list because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem.

Data Used to Assess Water Quality: One of one sample exceeded the evaluation guideline. Data were reported on a dry weight basis and were converted to wet weight by multiplying the dry-weight concentration by a factor of 1 minimum the percentage of moisture content expressed as a decimal (78% moisture content = .78). Two composite samples were collected from one site in Iron Gate Reservoir on the same day, and thus, the average of the two composite samples was calculated, per USEPA 2001, resulting in a sample value of 530.86 ppb. Mercury concentrations are assumed to be 100% methylmercury.

Evaluation Guideline: The USEPA 304(a) recommended water quality criterion for concentrations of methylmercury in fish tissue of trophic level 4 fish (150 - 500 mm; fillet wet weight) is 0.20 mg/kg. Total mercury is usually analyzed for most fish studies and assumed to be 100 percent methylmercury for the purposes of risk assessment (Klasing & Brodberg 2008). The fish consumption rate of 32 grams/day is considered more protective of human health since recommendations are now to eat 1 meal a week of fish to obtain necessary Omega 3 nutrition. The fish consumption rate of 32 grams/day is also protective of wildlife, as it protects 6 out of 7 endangered species.

Data Used to Assess Water Quality: Two of two composite samples exceeded the evaluation guideline. Data were reported on a dry weight basis and were converted to wet weight by multiplying the dry-weight concentration by a factor of 1 minus the percentage of moisture content expressed as a decimal (78% moisture content = .78). The resulting wet weight composite sample concentrations were .556 mg/kg and .505 mg/kg. Mercury concentrations are assumed to be 100% methylmercury.

Water Quality Objective/Criterion: Per the Basin Plan (NCRWQCB 2011): All waters shall be maintained free of toxic substances in concentrations that are toxic to, or that produce detrimental physiological responses in human, plant, animal, or aquatic life. Compliance with this objective will be determined by use of indicator organisms, analyses of species diversity, population density, growth anomalies, bioassays of appropriate duration, or other appropriate methods as specified by the Regional Water Board.

TMDL Project Code: 97
Date TMDL Approved by USEPA: 12/28/2010
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: Regional Board Conclusion:

This pollutant was placed on the section 303(d) List in a previous Integrated Report cycle.

No new information was reviewed for the current Integrated Report cycle. Therefore, the previous conclusion remains unchanged; however, a TMDL has been developed and approved by the USEPA and the approved implementation plan is expected to result in full attainment of the standard within a specified time frame. The previous conclusion is as follows:

This pollutant was added to the Section 303(d) List on May 29, 2008, by the US EPA as part of the 2006 303(d) List Update process, which applies to the mainstem Klamath River in the Klamath River Hydrologic Unit, Middle Klamath River Hydrologic Area, Oregon to Iron Gate reach, excluding the riverine reach from the Oregon border downstream to the beginning of Copco 1 Reservoir (i.e., the mainstem Klamath River from the beginning of Copco 1 Reservoir to Iron Gate Dam). This listing applies to the Iron Gate Reservoir.

This pollutant is being considered for removal from the Section 303(d) List under Section 4.11 of the Listing Policy. Two lines of evidence are available in the administrative record.

The LOE for microcystin toxin in the water column (LOE 26006) has an evaluation guideline (WHO 2003) that meets the requirements of the Listing Policy. The LOE for microcystin toxin in tissue (LOE 25755) has an evaluation guideline (Alexeff 2008) that State Water Board staff believes does not meet the requirements of the Listing Policy, due to the fact that the guideline has not been peer-reviewed or published in an official OEHHA agency document. Therefore, only data from LOE 26006 for microcystin in the water column were utilized to assess this pollutant. Data from LOE 25755 on microcystin in tissue are as follows, but were not utilized to assess this pollutant: Eight out of 25 tissue microcystin toxin samples exceeded the evaluation guideline (Alexeff 2008).

Based on the readily available data and information, the situation-specific weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the Section 303(d) List in the Water Quality Limited Segments category (i.e., sufficient justification to not delist). This conclusion is based on the staff findings that:

(1) On May 29, 2008, the US EPA identified the portion of the "Klamath River Hydrologic Unit (HU), Middle HA Hydrologic Area (HA), from Oregon to Iron Gate [reservoir]" that is impaired due to microcystin toxins as the area including the Copco 1 and 2 reservoirs, Iron Gate Reservoirs, and waters in between.

(2) Seven out of 14 water column microcystin toxin samples exceed the evaluation guideline used to interpret the water quality objective.

(3) Any exceedance of the evaluation guidelines indicates non-attainment of standards. In compliance with Section 4.11 of the Listing Policy, a water segment shall not be removed from the Section 303(d) List if the weight of evidence indicates non-attainment.

(4) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy.

(5) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy.

(6) Pursuant to Section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

Final Listing Decision: Do Not List on 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: Do Not List on 303(d) list (TMDL required list)(2016)
Revision Status Original
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: Carry over no new data
Regional Board Conclusion:

The pollutant was considered for placement on the section 303(d) list in a previous assessment cycle.

No new information was reviewed for this current assessment cycle. Therefore, the previous conclusion remains unchanged, and is as follows:

This pollutant is being considered for placement on the Section 303(d) List under Section 3.1 of the Listing Policy. Under Section 3.1, a single line of evidence is necessary to assess listing status. One line of evidence is available to assess protection of the commercial and sport fishing (COMM) beneficial use.

(3) The data in LOE 31885 evaluating the COMM beneficial use were all detect not quantifiable (DNQ) and the data reporting limit and method detection limit were above the evaluation guideline. Thus, per the Listing Policy the data were not used in this assessment. Therefore, there are no data available to assess against protection of the MUN beneficial use.

Regional Board Conclusion: Regional board conclusion:

This pollutant was considered for placement on the section 303(d) list in a previous assessment cycle.

No new information was reviewed for this current assessment cycle. Therefore, the previous conclusion remains unchanged and is as follows:

This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a minimum of one line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant.

One line of evidence is available to assess protection of the cold freshwater habitat (COLD) beneficial use, one line of evidence is available to assess protection of the warm freshwater habitat (WARM) beneficial use, and two lines of evidence are available to assess protection of the commercial and sport fishing (COMM) beneficial use.

(3) Zero of one fish tissue sample exceeds the evaluation guideline used to assess both the COLD and WARM beneficial uses. One of two fish tissue samples exceed the COMM evaluation guideline. These sample sizes are insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (A) 16 samples, or (B) greater than or equal 2 exceedances of the objective with less than 16 samples is needed for application of Table 3.1. SWAMP Data: SWAMP

Water Quality Objective/Criterion: Water Quality Control Plan, North Coast Region (NCRWQCB 2011): All waters shall be maintained free of toxic substances in concentrations that are toxic to, or that produce detrimental physiological responses in human, plant, animal, or aquatic life.
Objective/Criterion Reference: Water Quality Control Plan (Basin Plan) for the North Coast Region

Evaluation Guideline: The modified OEHHA Fish Contaminant Goal for polychlorinated biphenyls in fish tissue is 2.6 ppb. This screening level assumes an average body weight of 70 kg and a consumption rate of 32 g/day for a 30 year exposure over a 70-year lifetime. This constituent is a carcinogen therefore the risk level is set to one in a million. A cooking reduction factor of 1 is applied for skin-off fillets.
Guideline Reference: Development of Fish Contaminant Goals and Advisory Tissue Levels for Common Contaminants in California Sport Fish: Chlordane, DDTs, Dieldrin, Methylmercury, PCBs, Selenium, and Toxaphene

Spatial Representation: Data for this line of evidence for Iron Gate Reservoir was collected at 1 monitoring site [ Iron Gate Reservoir - 105PIG154]. Samples were collected from 1 location. DECISION ID
78048
Region 1
Iron Gate Reservoir

Pollutant: Selenium
Final Listing Decision: Do Not List on 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: Do Not List on 303(d) list (TMDL required list)(2016)
Revision Status Original
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a minimum of one line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant.

(3) Zero of one sample exceeds the evaluation guideline used to interpret the narrative toxicity objective, and this sample size is insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (A) 16 samples, or (B) greater than or equal 2 exceedances of the objective with less than 16 samples is needed for application of Table 3.1. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation: This region was not assessed this cycle. All decisions have been carried over from the previous cycle and remain the same.

State Board Review of Regional Board Conclusion and Recommendation:

State Board Decision Recommendation: After review of this Regional Board decision, SWRCB staff recommend the decision be approved by the State Board.
