Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant. Zero of the samples exceed the narrative toxicity water quality objective.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Zero of 8 water samples exceeded the Evaluation Guideline for propanil (none exceeded the narrative toxicity objective), and this does not exceed the allowable frequency listed in Table 3.1 of the Listing Policy. A minimum of sixteen samples is needed to determine if a beneficial use is fully supported using table 3.1.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Evaluation Guideline: Where valid testing has developed 96 hour LC50 values for aquatic organisms (the concentration that kills one half of the test organisms in 96 hours), the Board will consider one tenth of this value for the most sensitive species tested as the upper limit (daily maximum) for the protection of aquatic life. Other available technical information on the pesticide (such as Lowest Observed Effect Concentrations and No Observed Effect Levels), the water bodies and the organisms involved will be evaluated to determine if lower concentrations are required to meet the narrative objectives (CVRWQCB, 2007). The 5-day EC50 tested for freshwater diatom (Navicula pelliculosa) is 16 ug/L (Ecotoxicity, 2005).
