Regional Board Conclusion: "This pollutant is being considered for placement on the CWA section 303(d) List under section 3.1 of the Listing Policy. Under section 3.1 a single line(s) of evidence are necessary to assess listing status.

Three lines of evidence are available in the administrative record to assess this pollutant. None of the samples exceed the objective.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. None of the one samples exceeded the objective and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is fully supported using table 3.1.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met."

Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list. The readily available data and information is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating.

Pollutant: Selenium
Final Listing Decision: Do Not List on 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: New Decision
Revision Status Revised
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: During the 2016 cycle these data for Spring Lake were evaluated in Decision 46315 in the "Russian River HU, Middle Russian River HA, Santa Rosa HSA, tributaries to Santa Rosa Creek" waterbody. They are now being evaluated in the "Santa Rosa Hydrologic Subarea, Spring Lake (Santa Rosa Creek Reservoir)" waterbody as is appropriate.

This pollutant is being considered for placement on the CWA section 303(d) List under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status. One line of evidence are available in the administrative record to assess this pollutant. Zero of one samples exceed the evaluation guideline. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Zero of one samples exceeded the evaluation guideline and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is fully supported using table 3.1. 4. Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under sections 3.5 and 3.11 of the Listing Policy. Under this section 3.11 when all other listing factors do not result in the listing of a water segment but information indicates non-attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates that water quality standard is not attained. If the weight of evidence indicates non-attainment, the water segment shall be placed on the CWA section 303(d) List.

Seven lines of evidence are available in the administrative record to assess mercury concentrations in fish fillets.

WILD beneficial use:
1 of 1 sample of trophic level 4 fish exceed the mercury objective and the annual average is based on 10 fish.

COMM and MUN beneficial uses:
1 of 1 sample of trophic level 4 fish exceed the mercury objective and the annual average is based on 6 fish. Fish used in the COMM assessment are limited to lengths that are within Calif. Dept. of Fish and Wildlife legal size limits applicable to this waterbody.
0 of 1 sample exceed the COMM and the MUN criteria for mercury.

Aquatic Life:
0 of 1 sample exceed the criteria for mercury in water for the COLD beneficial use.
0 of 1 sample exceed the guideline for mercury in sediment for the COLD and WARM beneficial uses.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for placing this water segment-pollutant combination from the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. One of one sample exceed the objective for the WILD beneficial use. The annual average of the exceeding sample is based on 10 fish that are trophic level 4. An aggregate of eight or more fish within a sample are needed to determine non-attainment of the mercury objective following weight of evidence in Listing Policy section 3.11.
3. This process is scientifically defensible and reproducible.

Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be placed on the section 303(d) list because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem.

DECISION ID
105187
Region 1
Santa Rosa Hydrologic Subarea, Spring Lake (Santa Rosa Creek Reservoir)

Pollutant: Pesticides
Final Listing Decision: Do Not List on 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: New Decision
Revision Status Original
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: These pollutants are being considered for placement on the Section 303(d) List under Section 3.1 of the Listing Policy. Under Section 3.1, a single line of evidence is necessary to assess listing status.

At least one line of evidence is available for each pollutant evaluated in this decision. Data were evaluated to determine protection of the following beneficial uses: COLD, WARM, and COMM.

None of the water and sediment samples exceed the objectives for the protection of COLD, WARM, and COMM.

3. None of the samples exceeded the objectives for COLD,, WARM, and COMM. Additionally, the sample size for each pesticide is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating as a minimum of 16 samples is needed to determine if each beneficial use is fully supported using table 3.1.
4. Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

State Board Review of Regional Board Conclusion and Recommendation:

State Board Decision Recommendation: After review of this Regional Board decision, SWRCB staff recommend the decision be approved by the State Board.
