This pollutant is being considered for removal from the section 303(d) list under section 4.7 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.
Two lines of evidence are available in the administrative record to assess this pollutant. This waterbody was originally listed for nitrate based on 100% exceedances (out of 16 samples) of the Nitrate water quality objective for Municipal and Domestic Supply (MUN). But, this water body is not designated in Table 2.1 of the Basin Plan for the MUN beneficial use. However, there is evidence of a nuisance condition related to over growth of aquatic vegetation, algae and wide swings in Dissolved Oxygen levels in the lake. Each of these are caused (at least in part) by the high levels of nutrients, specifically nitrate, in the lake.
Two photos are associated with the LOE and show dense aquatic vegetation in and around the lake. This vegetation not only contributes to wide swings in dissolved oxygen levels but also prevents recreational use of the lake (i.e. fishing).
CCAMP staff collected 16 nitrate samples, monthly between January 2000 and February 2001. The range of nitrate measured in these samples was 28.0 - 37.1 mg/L (Nitrate as N).
CCAMP staff also took dissolved oxygen measurements with each site visit. Dissolved oxygen levels ranged from 5.05 - 21.0 mg/L.
Finally CCAMP chlorophyll a data shows that in summer months the water column chlorophyll a levels are far exceeding the evaluation guideline used for streams. Chlorophyll a levels ranged from <0.5 ug/L to 160 ug/L. Three of these measurements exceeded the evaluation guideline.
Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list.
This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Photo documentation shows the extent of the nuisance condition and nitrate levels are far above the levels expected to cause eutrophic conditions. Therefore Oso Flaco Lake nitrate levels (16 of 16 samples) exceed the allowable frequency as described in Section 4.7.1 of the Listing Policy.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met. |

CCAMP data collected monthly in Oso Flaco Lake between January 2000 and January 2001 show elevated Nitrate levels which likely contributed to the elevated chlorophyll a concentrations in the water column, wide swings in Dissolved Oxygen concentrations and pH levels. Photo documentation also shows nuisance aquatic vegetation and algae filling the lake in summer months. Nitrate ranged from 28.0 - 31.7 mg/L in monthly grab samples taken from the lake.
