One line of evidence is available in the administrative record to assess this pollutant. None of the 12 samples exceed the General water quality objective as it applies to the Cold Freshwater Habitat beneficial use.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. However, there are an insufficient number of samples to make a "use rating" decision. Central Coast Water Board staff require a minimum of 16 samples to make a "use rating" decision of Fully Supporting.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. None of the 12 samples exceed the General water quality objective as it applies to the Cold Freshwater Habitat beneficial use and this does not exceed the allowable frequency listed in Table 3.1 of the Listing Policy.

Two water quality objectives are assessed: None of the 29 samples exceed the dissolved oxygen water quality objective for Warm Freshwater Habitat and 13 of 29 samples exceed the general water quality objective for oxygen saturation (when applied as a single sample maximum). However, the Basin Plan objective states that the median oxygen saturation value shall not fall below 85% and the median value did not exceed this criterion.

Three lines of evidence are available in the administrative record to assess this pollutant. Two of the 22 samples exceed the Evaluation Guideline (Sigler et al., 1984) applied to protect for aquatic life beneficial uses.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. However, there are an insufficient number of samples to make a "use rating" decision. Central Coast Water Board staff require a minimum of 26 samples to make a "use rating" decision of Fully Supporting.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Two of the 22 samples exceed the Evaluation Guideline (Sigler et al., 1984) applied to protect for aquatic life beneficial uses and this does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

The following is a summary of the results from individual toxicity tests. The single sample (tested for toxicity to plants) exhibited significant reduction in cell density relative to the control. However, the single sample did not exhibit a significant increase in mortality compared to the laboratory control samples for invertebrates or for vertebrate test organisms.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. Weight of Evidence: This pollutant is being considered for placement on the section 303(d) list under sections 2.1 and 3.2 of the Listing Policy.

Nine lines of evidence are available in the administrative record to assess this pollutant. Based on section 3.2 the site exceeded numeric objectives for conventional pollutants. According to the binomial distribution, waters shall be placed on the section 303(d) list if the number of measured exceedances supports rejection of the null hypothesis as presented in Table 3.2.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Six of the 27 samples exceed the Warm Freshwater Habitat water quality objective and 7 of the 27 samples exceed the numeric objectives for Non-Contact Recreation and Water Contact Recreation. Each of these exceeds the allowable frequency listed in Table 3.2 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

This waterbody was originally listed for nitrate based on 100% exceedances (out of 16 samples) of the Nitrate water quality objective for Municipal and Domestic Supply (MUN). However, there is evidence of a nuisance condition related to over growth of aquatic vegetation, algae and wide swings in Dissolved Oxygen levels in the lake. Each of these are caused (at least in part) by the high levels of nutrients, specifically nitrate, in the lake.

Two photos are associated with the LOE and show dense aquatic vegetation in and around the lake. This vegetation not only contributes to wide swings in dissolved oxygen levels but also prevents recreational use of the lake (i.e. fishing).

CCAMP staff collected 16 nitrate samples, monthly between January 2000 and February 2001. The range of nitrate measured in these samples was 28.0 - 37.1 mg/L (Nitrate as N).

CCAMP staff also took dissolved oxygen measurements with each site visit. Dissolved oxygen levels ranged from 5.05 - 21.0 mg/L.

Finally CCAMP chlorophyll a data shows that in summer months the water column chlorophyll a levels are far exceeding the evaluation guideline used for streams. Chlorophyll a levels ranged from <0.5 ug/L to 160 ug/L. Three of these measurements exceeded the evaluation guideline.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Photo documentation shows the extent of the nuisance condition and nitrate levels are far above the levels expected to cause eutrophic conditions. Therefore Oso Flaco Lake nitrate levels (16 of 16 samples) exceed the allowable frequency as described in Section 4.7.1 of the Listing Policy.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

Data Used to Assess Water Quality: CCAMP data collected monthly in Oso Flaco Lake between January 2000 and January 2001 show elevated Nitrate levels which likely contributed to the elevated chlorophyll a concentrations in the water column, wide swings in Dissolved Oxygen concentrations and pH levels. Photo documentation also shows nuisance aquatic vegetation and algae filling the lake in summer months. Nitrate ranged from 28.0 - 31.7 mg/L in monthly grab samples taken from the lake. Dissolved Oxygen measurements (including both monthly grab samples and a single summer time pre-dawn sampling event) ranged from 5.05 mg/L to 21.0 mg/L. This indicates not only depressed but also super saturated oxygen conditions. Chlorophyll a measurements ranged between <1.0 ug/L and 160 ug/L. Three of these measurements were above 40 ug/L, the evaluation guideline used in this assessment.
