Regional Board Staff Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status.

Three lines of evidence, one which assesses E. coli data against the REC-1 beneficial use and two which assess fecal coliform data against the MUN beneficial use, are available in the administrative record to assess this pollutant. In August 2018 the State Water Resources Control Board adopted the bacteria objectives which assess E. coli geometric mean data against the REC-1 beneficial use. These objective supersede any other water quality objectives for the REC-1 beneficial use. In instances where no geometric mean calculation is available, the bacteria objectives stipulate that the attainment of the REC-1 beneficial use shall be assessed using E. coli Statistical Threshold Value (STV) data. This decision is based on E. coli STV data and is as follows: 0 of 12 samples exceed the water quality objective.

Also available in the administrative record are fecal coliform data, which have been assessed against the MUN beneficial use using both geometric mean and STV calculations. These samples sizes are as follows: 4 of 11 samples exceed the water quality objective for fecal coliform using geometric mean calculations; 2 of 11 samples exceed the water quality objective using fecal coliform STV data. Both these LOE's are written using the same data and should not be added for the purposes of beneficial use attainment assessment.
