Regional Board Staff Conclusion: This pollutant is being considered for delisting under sections 4.6 of the Listing Policy. Under section 4.6 two lines of evidence are necessary to assess listing status.

Four lines of evidence are available in the administrative record to assess this pollutant. Based on section 4.6, there is no significant toxicity associated with this pollutant and the number of pollutant exceedances does not exceed the frequency allowed by the Listing Policy.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of removing this water segment-pollutant combination from the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The sediment quality guideline used complies, with the requirements of section 6.1.3 of the Policy.
2. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
3. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
4. Four of 93 and 0 of 17 samples exceeded the Effects Range Medium sediment guideline, and data shows there is not sediment toxicity associated with the pollutant exceedances. This does not exceed the allowable frequency listed in Table 4.1 of the Listing Policy.
5. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.
 
Regional Board Staff Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the section 303(d) list because applicable water quality standards for the pollutant are not being exceeded.

Under section 3.6 at least two lines of evidence are necessary to assess listing status for pollutants sediment, and pollutant concentrations in sediment must be associated with sediment toxicity to justify adding that pollutant to the CWA section 303(d) List.

1. The Dominguez Channel and Los Angeles and Long Beach Harbors Toxics and Metals TMDL was approved by USEPA on 03/23/2012.
2. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

One line of evidence is available in the administrative record to assess this pollutant. In four new individual fact sheets, independently recommended for placement on the 303(d) list under section 3.9 of the Listing Policy, a sufficient number of samples exceeded the sediment quality guideline for the following PAHs: Pyrene, Phenanthrene, Chrysene, and Benzo (a) pyrene. Although sediment toxicity has been observed, significant benthic degradation has been recorded and this may be linked with these specific PAH pollutant concentrations in this water body segment.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of removing the PAH sediment-pollutant combination and replacing this general PAH listing with the individually listings of Pyrene, Phenanthrene, Chrysene, and Benzo (a) pyrene on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. In the new available data a sufficient number of samples exceeded the specific PAH sediment quality guideline for each PAH. The benthic community impacts may be better linked with the effects of these individual pollutants in the sediment of this water body segment.
