Water Body Name: Copco Lake
Water Body ID: CAL1053802120020720133912
Water Body Type: Lake & Reservoir

DECISION ID
102592
Region 1
Copco Lake

Pollutant: Aldrin
Final Listing Decision: Do Not List on 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: New Decision
Revision Status Revised
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under section 3 of the Listing Policy. Under section 3 a single line of evidence are necessary to assess listing status.

Two lines of evidence are available in the administrative record to assess this pollutant. None of the samples exceed the objective.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. None of the samples exceeded the objective and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is fully supported using table 3.1.
4. Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list. The readily available data and information is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating.

Pollutant: Zinc
Final Listing Decision: Do Not List on 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: Do Not List on 303(d) list (TMDL required list)(2016)
Revision Status Revised
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a minimum of one line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category (i.e., sufficient justification to not list). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. (3) Zero of twelve samples exceed the evaluation guideline used to interpret the narrative toxicity objective, and this sample size is insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (A) 16 samples, or (B) greater than or equal 2 exceedances of the objective with less than 16 samples is needed for application of Table 3.1. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

DECISION ID
72491
Region 1
Copco Lake

Pollutant: Mercury
Final Listing Decision: List on 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: List on 303(d) list (TMDL required list)(2016)
Revision Status Revised
Sources: A Source Unknown
Expected TMDL Completion Date: 2025
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.5 of the Listing Policy. Under section 3.5 a single line of evidence is necessary to assess listing status.

Six lines of evidence are available in the administrative record to assess mercury concentrations in fish fillets.
LOE 47582 and LOE 46505 are replaced with LOE 133913.
LOE 31886 and LOE 47581 are replaced with LOE 133914.
LOE 47498 and LOE 44818 are replaced with LOE 132974.
LOEs 133913, 133914, and 132974 are reassessments of the same data according to new mercury objectives.

WILD beneficial use: LOEs 133915, 133912, and 133164 each have one of one sample exceeding the mercury objective.

COMM beneficial use: LOEs 132974 and 133914 each have one of one sample exceeding the mercury objective. LOE 133913 has 0 of 1 sample exceeding the mercury objective. Fish used in the COMM assessment are limited to lengths that are within Calif. Dept. of Fish and Wildlife legal size limits applicable to this waterbody.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Three of three samples exceed the objective for the WILD beneficial use. Two of three samples exceed the objective for the COMM beneficial use. Exceedances are from multiple years for each beneficial use and thus exceed the allowable frequency listed in Table 3.1 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be placed on the section 303(d) list because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem.

Data Used to Assess Water Quality: Two of two composite samples exceeded the evaluation guideline. Data were reported on a dry weight basis and were converted to wet weight by multiplying the dry-weight concentration by a factor of 1 minus the percentage of moisture content expressed as a decimal (78% moisture content = .78). The resulting wet weight composite sample concentrations were .536 mg/kg and .356 mg/kg. Mercury concentrations are assumed to be 100% methylmercury.

Water Quality Objective/Criterion: Per the Basin Plan (NCRWQCB 2011): All waters shall be maintained free of toxic substances in concentrations that are toxic to, or that produce detrimental physiological responses in human, plant, animal, or aquatic life. Compliance with this objective will be determined by use of indicator organisms, analyses of species diversity, population density, growth anomalies, bioassays of appropriate duration, or other appropriate methods as specified by the Regional Water Board.
Objective/Criterion Reference: Water Quality Control Plan (Basin Plan) for the North Coast Region

Evaluation Guideline: The USEPA 304(a) recommended water quality criterion for concentrations of methylmercury in fish tissue of trophic level 4 fish (150 - 500 mm; fillet wet weight) is 0.20 mg/kg. Total mercury is usually analyzed for most fish studies and assumed to be 100 percent methylmercury for the purposes of risk assessment (Klasing & Brodberg 2008). The fish consumption rate of 32 grams/day was utilized to develop the above criterion, as it is considered to be protective of recent human health recommendations to eat 1 meal a week of fish to obtain necessary Omega 3 nutrition. The fish consumption rate of 32 grams/day is also protective of wildlife, as it protects 6 out of 7 endangered species.

Water Quality Objective/Criterion: Water Quality Control Plan, North Coast Region (NCRWQCB 2011): All waters shall be maintained free of toxic substances in concentrations that are toxic to, or that produce detrimental physiological responses in human, plant, animal, or aquatic life.

The fish consumption rate of 32 grams/day is considered more protective of human health since recommendations are now to eat 1 meal a week of fish to obtain necessary Omega 3 nutrition. The fish consumption rate of 32 grams/day is also protective of wildlife, as it protects 6 out of 7 endangered species.

Data Used to Assess Water Quality: One of one sample exceeded the evaluation guideline. Data were reported on a dry weight basis and were converted to wet weight by multiplying the dry-weight concentration by a factor of 1 minimum the percentage of moisture content expressed as a decimal (78% moisture content = .78). Two composite samples were collected from one site in Copco Reservoir on the same day, and thus, the average of the two composite samples was calculated, per USEPA 2001, resulting in a sample value of .446 mg/kg. Mercury concentrations are assumed to be 100% methylmercury.

Sources: Agriculture | Drainage/Filling Of Wetlands | Grazing-Related Sources | Road Construction | Silviculture
TMDL Name: Klamath River Nutrients, Temperature, DO, and Microcystin.
TMDL Project Code: 97
Date TMDL Approved by USEPA: 12/28/2010
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: Regional Board Conclusion:

The pollutant was considered for placement on the section 303(d) list in a previous assessment cycle.

No new information was reviewed for this current assessment cycle. Therefore, the previous conclusion remains unchanged, and is as follows:

This pollutant is being considered for removal on the section 303(d) list under sections 2.2 and 4.1 of the Listing Policy. Under section 4.1 of the Policy, a minimum of one line of evidence is needed to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list (i.e., sufficient justification to not delist).

There is sufficient justification to place it in the Being Addressed portion of the 303(d) list because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard.

This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. (3) Four of 13 water column microcystin toxin samples and 21 of 22 fish tissue microcystin toxin samples exceed their respective evaluation guidelines, and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy. (4) The Klamath River TMDL has been approved by the North Coast Regional Water Quality Control Board in March 2010 and approved by USEPA on December 28, 2010. (5) Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Conclusion: Regional Board Conclusion:

The pollutant was considered for placement on the section 303(d) list in a previous assessment cycle.

No new information was reviewed for this current assessment cycle. Therefore, the previous conclusion remains unchanged, and is as follows:

This pollutant is being considered for placement on the Section 303(d) List under Section 3.1 of the Listing Policy. Under Section 3.1, a single line of evidence is necessary to assess listing status. One line of evidence is available to assess protection of the commercial and sport fishing (COMM) beneficial use.

(3) The data in LOE 31885 evaluating the COMM beneficial use were all detect not quantifiable (DNQ) and the data reporting limit and method detection limit were above the evaluation guideline. Thus, per the Listing Policy the data were not used in this assessment. Therefore, there are no data available to assess against protection of the MUN beneficial use. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation: This is a decision previously approved by the State Water Resources Control Board and the USEPA. No new data were assessed by the Regional Board for the current cycle. The decision has not changed.

These pollutants are being considered for placement on the Section 303(d) List under Section 3.1 of the Listing Policy. Under Section 3.1, a single line of evidence is necessary to assess listing status. Nine lines of evidence are available to assess protection of the cold freshwater habitat (COLD) beneficial use, nine lines of evidence are available to assess protection of the warm freshwater habitat (WARM) beneficial use, and ten lines of evidence are available to assess protection of the commercial and sport fishing (COMM) beneficial use.

Per the Listing Policy, fish tissue data from LOEs 44512, 44825, and 44515 assessing the COMM beneficial use could not be evaluated because the laboratory data reporting limit(s) were above the objectives and therefore the results could not be quantified with the level of certainty required by the Listing Policy.

(3) Zero of one fish tissue sample for each of the pesticides assessed exceed both the COLD and WARM objective. Zero of one fish tissue sample exceed the COMM objective for chlordane, endrin, hexachlorobenzene, Lindane/gamma Hexachlorocyclohexane, Total DDT, and alpha-endosulfan. Zero of two fish tissue samples exceed the COMM objective for DDT. These sample sizes are insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (A) 16 samples, or (B) greater than or equal 2 exceedances of the objective with less than 16 samples is needed for application of Table 3.1.

Water Quality Objective/Criterion: Per the Basin Plan (NCRWQCB 2011): No individual pesticide or combination of pesticides shall be present in concentrations that adversely affect beneficial uses. There shall be no bioaccumulation of pesticide concentrations found in bottom sediments or aquatic life. Waters designated for use as domestic or municipal supply shall not contain concentrations of pesticides in excess of the limiting concentrations set forth in California Code of Regulations, Title 22, Division 4, Chapter 15, Article 4, Section 64444, and listed in Table 3.2 of the Basin Plan.
Objective/Criterion Reference: Water Quality Control Plan (Basin Plan) for the North Coast Region

Evaluation Guideline: The modified OEHHA Fish Contaminant Goal for total DDT in fish tissue is 15 ppb. This screening level assumes an average body weight of 70 kg and a consumption rate of 32 g/day for a 30 year exposure over a 70-year lifetime. This constituent is a carcinogen therefore the risk level is set to one in a million. A cooking reduction factor of 1 is applied for skin-off fillets. (Klasing, S., and R. Brodberg, 2008)

Final Listing Decision: Do Not List on 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: Do Not List on 303(d) list (TMDL required list)(2016)
Revision Status Original
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: Regional Board Conclusion:

This pollutant was considered for placement on the section 303(d) list in a previouis assessment cycle.

No new information was reviewed for this curren assessment cycle. Therefore, the previous conclusion remains unchanged, and is as follows:

This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy.

Regional Board Decision Recommendation: This is a decision previously approved by the State Water Resources Control Board and the USEPA. No new data were assessed by the Regional Board for the current cycle. The decision has not changed.

Four lines of evidence are available to assess protection of the cold freshwater habitat (COLD) beneficial use.

(3) Zero of four sediment samples for both fluoranthene and naphthalene exceed the evaluation guideline used to assess the MUN beneficial use, and zero of three sediment samples for both phenanthrene and pyrene exceed the evaluation guideline used to assess the MUN beneficial use. These sample sizes are insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (A) 16 samples, or (B) greater than or equal 2 exceedances of the objective with less than 16 samples is needed for application of Table 3.1.
Objective/Criterion Reference: Water Quality Control Plan (Basin Plan) for the North Coast Region

Evaluation Guideline: The OEHHA Fish Contaminant Goal for selenium in fish tissue is 7.4 ppm. This screening level assumes an average body weight of 70 kg and a consumption rate of 32 g/day. A background dietary consumption rate of 0.114 mg/day is applied for this micronutrient.
Guideline Reference: Development of Fish Contaminant Goals and Advisory Tissue Levels for Common Contaminants in California Sport Fish: Chlordane, DDTs, Dieldrin, Methylmercury, PCBs, Selenium, and Toxaphene

Spatial Representation: Data for this line of evidence for Copco Lake was collected at 1 monitoring site [ Copco Lake - 105PCL181]. Samples were collected from 1 location. Individual sample locations consisted of an area within a given waterbody from which fish tissue samples were collected. The number of sample locations per waterbody was based on the overall size of the waterbody (SWAMP, 2010). Specifics of individual sampling locations can be found in the supplemental report entitled "Cruise Report for the Surface Waters Ambient Monitoring Program (SWAMP) Bioaccumulation Screening Study in California Lakes and Reservoirs, Sampling Dates: April 2008- November 2008" (SWAMP, 2009).
Temporal Representation: Data was collected on a single day 5/12/2008.
Environmental Conditions: Staff is not aware of any special conditions that might affect interpretation of the data.
QAPP Information: Samples were collected, processed, and analyzed in accordance with the methods described in Quality Assurance Project Plan "Screening Study of Bioaccumulation in California Lakes and Reservoirs." (SWAMP, 2008).
