Regional Board Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under section 4 of the Listing Policy due to a change in water quality standards.

The State Water Boards Water Quality Control Plan for Inland Surface Waters, Enclosed Bays, and Estuaries of California (the ISWEBE Plan) contains two bacteria water quality objectives applicable to the REC-1 beneficial use which were adopted on August 7, 2018: where the salinity level of a waterbody is equal to or less than 1 part per thousand 95 percent or more of the time, the E. coli bacteria objective applies; and where the salinity level of a waterbody is greater than 1 part per thousand 95 percent or more of the time, the Enterococci bacteria objective applies.

These objectives supersede the fecal coliform water quality objective for water contact recreation. Consequently, the fecal coliform objective for water contact recreation is no longer applicable to this waterbody and those LOEs have been removed from this decision. Therefore, this waterbody is being removed from the CWA section 303(d) List under section 4 of the Listing Policy due to a change in water quality standards.

However, two lines of evidence (LOEs) are available in the administrative record to assess this pollutant and the non-contact recreation use. Therefore, this pollutant is being considered for placement on the CWA section 303(d) List under section 3.3 of the Listing Policy. Under section 3.3 a single line of evidence is necessary to assess listing status.

Onr of the 27 samples exceed the water quality objective for non-contact recreation.

After review of the available data and information for the non-contact recreation beneficial use, RWQCB staff concludes that the water body-pollutant combination should not be placed on the CWA section 303(d) List because applicable water quality standards for the pollutant are not being exceeded.

In accordance with section 2.2 of the Policy, there is sufficient justification to place it in the Being Addressed portion of the 303(d) List because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. One of the 27 samples exceed the water quality objective for non-contact recreation, and this does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy.
4. The Santa Maria River Watershed Fecal Indicator Bacteria TMDL has been approved by the USEPA on 4/24/2013.
5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the CWA section 303(d) List under section 4 of the Listing Policy due to a change in water quality standards.

This water body pollutant combination should be placed in the Being Addressed portion of the CWA 303(d) List because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard.

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.

Six lines of evidence (LOEs) are available in the administrative record to assess this pollutant. Four LOEs summarize unionized ammonia data and two aquatic life beneficial uses. TwoLOEs summarize total ammonia data but using two different pollutant names: Nitrogen, ammonia (Total Ammonia) and Ammonia as Nitrogen. These total ammonia pollutant names are interchangeable and so the sample and exceedance counts for these two names are summed. Zero of 26 samples exceed the Basin Plan general objective for unionized ammonia set to protect aquatic life. None of the 28 samples exceed the EPA's Lifetime Health advisory level for total ammonia in drinking water.

This decision replaces the two previously approved decisions for each of the pollutants unionized ammonia (Decision 22636) and total ammonia (Decision 22693) and contains all of the LOEs from those decisions in addition to new LOEs.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Zero of 26 samples exceed the Basin Plan general objective for unionized ammonia set to protect aquatic life. Regional Board Conclusion: Benthic Community Effects is being considered for placement on the section 303(d) list under sections 3.9 and 3.2 of the Listing Policy. Under section 3.9, an additional line of evidence associating the Benthic Community Effects with a water or sediment concentration of pollutants is necessary to assess listing status. One line of evidence is available in the administrative record to assess this indicator. The single sample exceeded the water quality objective.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing Benthic Community Effects in this water segment on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:

The single sample exceeded the Evaluation Guideline (Siepmann and Finlayson 2000, with minor corrections to significant figures as described in Beaulaurier et al., 2005) applied to protect for aquatic life beneficial uses. This sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is supported using table 3.1.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:

1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.

2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.

3. This sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status.

Twelve lines of evidence are available in the administrative record to assess this pollutant. Four of 30 samples exceed the Cold Freshwater Habitat objective but none of the 30 samples exceed the objective for Warm Freshwater Habitat. The Basin Plan general water quality objective for oxygen saturation states that the median value shall not fall below 85% and although 9 of 30 samples are below 85% saturation, the median of the data does not exceed (fall below) the Objective. Furthermore, the objective is only applied ¿for waters not mentioned by a specific beneficial use¿¿ and this waterbody is designated for both Cold and Warm Water Habitats. Therefore, the use support rating for oxygen saturation is set at Insufficient Information.

Note that the pollutant name for the older LOEs and decisions is electrical conductivity. This was an error and the pollutant name should have always been specific conductivity. For this reason, the pollutant name was changed for this decision and sample and exceedance counts are summed for LOEs with both pollutant names in this assessment for specific conductivity.

And since the construction of Twitchell Reservoir there is a permanent barrier to migration. Therefore this temperature guideline, which is specific to steelhead trout is will not be used to determine impairment in this water segment and the use support rating is set to insufficient information.

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status.

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.1 and section 3.6 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.

The pollutant name has been changed to Toxicity. In previous listing cycles, separate fact sheets were developed for Sediment Toxicity and Unknown Toxicity (AKA water toxicity). In this current assessment cycle, those two fact sheets and all of the associated LOEs are combined into this single fact sheet for Toxicity.

Eight lines of evidence are available in the administrative record to assess this pollutant. One sample can have multiple toxicity test results but will be counted only once. One sample is defined as being collected on the same day at the same location with the same lab sample id (if provided).

For water samples, six of the LOEs summarize a single sample from February 2007 (LOEs 23519, 23520, 23521, 23522, 23530 and 23531). One LOE summarizes a single sample from June 2007 (LOE 52990). The February 2007, sample was tested using three test species (a vertebrate, an invertebrate and an algae). This sample exhibited significant reduction in cell density of the algae relative to the control but, did not exhibit significant increases in mortality of the vertebrate or invertebrate when compared to the relevant laboratory control. In June of 2007 a second sample was collected from Alamo Creek and again tested for toxic effects to three test species (a vertebrate, an invertebrate and an algae). The results for the June 2007 sample are all included in LOE 52990. The June 2007 sample also exhibited significant reduction in cell density of the algae relative to the control but did not have significant toxic effects to the vertebrate or invertebrate test organisms. Therefore both of the samples (February and June of 2007) resulted in significant toxic effects to the algae test organism and therefore exceed the narrative General Objective for toxicity, set to protect for aquatic life beneficial uses.

For the sediment sample, one line of evidence is available in the administrative record to assess this pollutant. The single sample did not exceed the water quality objective for aquatic life protection meaning the sample did not result in a significant toxic effect to the test organism.

This sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is supported and a minimum of two exceedances is needed to determine if beneficial uses are not supported using table 3.1. Therefore, the use support rating is set to 'insufficient information'.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Both water samples exhibited significant reduction in algal cell density relative to the control and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
