Regional Board Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under section 4.11 of the Listing Policy. Under this section when all other delisting factors do not result in the delisting of a water segment but information indicates attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates that water quality standard is attained. If the weight of evidence indicates attainment, the water segment shall be removed from the CWA section 303(d) List.

Four lines of evidence are available in the administrative record to assess mercury concentrations in fish fillets.
LOEs 44914 and 47504 are replaced with LOE 132982.
LOEs 47587 and 47588 are replaced with LOE 133935.
LOEs 132982 and 133935 are reassessments of the same data according to the mercury objectives.

WILD beneficial use: LOEs 133936 and 132935 each have one of one sample exceeding the mercury objective.

COMM beneficial use: LOE 132982 has 1 of 1 sample exceeding the mercury objective. LOE 133935 has 8 of 8 samples exceeding the mercury objective. Fish used in the COMM assessment are limited to lengths that are within Calif. Dept. of Fish and Wildlife legal size limits applicable to this waterbody.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. Two of 2 samples exceed the WILD objective and 9 of 9 samples exceed the COMM objective and this and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. A minimum of 3 annual averages based on composite fish tissue samples must meet the standard in order to indicate attainment of the standard.
3. This process is scientifically defensible and reproducible.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

If trophic level 3 fish are used in the assessment then the Prey Fish Water Quality Objective must also be used to determine that the Sport Fish Objective is being met. The fish consumption rate of 32 grams/day is also protective of wildlife, as it protects 6 out of 7 endangered species.

At least one line of evidence is available for each pollutant evaluated in this decision. Data were evaluated to determine protection of the following beneficial uses: COLD, WILD, WARM, and COMM.

None of the water and sediment samples exceed the objectives for the protection of COLD, WILD, WARM, and COMM.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List. This conclusion is based on the staff findings that:

1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. None of the samples exceeded the objectives for COLD, WILD, WARM, and COMM. Additionally, the sample size for each pesticide is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating as a minimum of 16 samples is needed to determine if each beneficial use is fully supported using table 3.1.
4. Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

This screening level assumes an average body weight of 70 kg and a consumption rate of 32 g/day for a 30 year exposure over a 70-year lifetime. This constituent is a carcinogen therefore the risk level is set to one in a million. A cooking reduction factor of 1 is applied for skin-off fillets.

Regional Board Conclusion: This pollutant is being considered for placement on the Section 303(d) List under Section 3.1 of the Listing Policy. Under Section 3.1, a single line of evidence is necessary to assess listing status. One line of evidence is available to assess protection of the commercial and sport fishing (COMM) beneficial use.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category (i.e., sufficient justification to not list). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy. (3) Zero of one fish tissue sample exceeds the evaluation guideline used to interpret the narrative toxicity objective, and this sample size is insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (A) 16 samples, or (B) greater than or equal 2 exceedances of the objective with less than 16 samples is needed for application of Table 3.1. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
