Regional Board Conclusion: This pollutant is being considered for removal on the section 303(d) list under section 4.1 of the Listing Policy. Under section 4.1 a single line of evidence is necessary to assess listing status.

Two lines of evidence are available in the administrative record to assess this pollutant. An OEHHA fish consumption advisory has been established in this water body segment. Under section 4.4 of the Listing Policy any water body segment where a health advisory against consumption of edible resident organisms has been issued shall remain listed on the section 303(d) list, until the advisory has been removed or data shows standards are being met in the water body.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of not removing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that an OEHHA fish consumption advisory has been established for this pollutant and fish tissue samples from nearby areas of the harbor (outer harbor) exceed the fish tissue guideline for human consumption.

Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.
 
Regional Board Decision Recommendation: This is a decision previously approved by the State Water Resources Control Board and the USEPA. No new data were assessed by the Regional Board for the current cycle. The decision has not changed.

Regional Board Conclusion: This pollutant is being considered for removal on the CWA section 303(d) List under sections 2.2 and 4.3 of the Listing Policy. Under SECTION 4.3 of the Policy, a minimum of one line of evidence is needed to assess listing status.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. There is sufficient justification to place it in the Being Addressed portion of the CWA 303(d) List because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. 1006 of 1933, 294 of 1046, 160 of 1064, 576 of 1945 and 1729 of 3362 samples exceeded the OBJECTIVE and these exceed the allowable frequency listed in Table 4.2 of the Listing Policy.
4. The Harbor Beaches of Ventura County was approved by USEPA on 12/08/2008.
5. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

One line of evidence is available in the administrative record to assess this pollutant. An OEHHA fish consumption advisory has been established in this water body segment. Under section 4.4 of the Listing Policy any water body segment where a health advisory against consumption of edible resident organisms has been issues shall remain on the section 303(d) list. In this case, there are no current tissue data available for evaluation, however, fish tissue samples from nearby areas of the harbor (outer harbor) exceed the fish tissue guideline for human consumption.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of not removing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that an OEHHA fish consumption advisory has been established for this pollutant and fish tissue samples from nearby areas of the harbor (outer harbor) exceed the fish tissue guideline for human consumption.

One line of evidence is available in the administrative record to assess this pollutant. A TMDL has been developed and approved by USEPA and an approved implementation plan is expected to result in attainment of the standard. The Santa Monica Bay Bacteria Dry Weather TMDL was approved by RWQCB on January 24, 2002 and subsequently approved by USEPA. The Santa Monica Bay Bacteria Wet Weather TMDL was approved by RWQCB on December 12, 2002 and approved by USEPA on June 19, 2003.

It is not known if the beach closure information is backed by coliform data. Beach closure information should not be placed on the section 303(d) list because it is not a pollutant or toxicity (section 2 of the Listing Policy).

Six lines of evidence are available in the administrative record to assess this pollutant.

Lines of Evidence (LOE) 137 and 141 will not be considered in this decision because that data has been incorporated into the re-evaluated data, in LOE 28239 and 28238 which combines old and newer data and eliminates some previous exceedances due to remediation operations that have changed surface sediment conditions. LOE 137 incorrectly lists 14 exceedances out of 16 sample, while a reanalysis of the data suggest only two exceedances out of 16 samples, which is listed in LOE 28239. LOE 141, will not be considered in this decision because the LOE included sediment samples from deeper cores, along with the samples taken from the surface. Deeper core samples do not impact beneficial uses. LOE 23238 includes the reevaluated data from 141 considering only surface cores.

The Port of Los Angeles has created some shallow water habitat in Cabrillo Beach area which has added clean sediment on top of sample sites with elevated copper, thus conditions have improved and beneficial uses are no longer negatively impacted due to copper. Newer data, listed in LOE 28224, shows no copper exceedences.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of removing this water segment-pollutant combination from the section 303(d) list.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Zero of four water column samples exceeded the California Toxics Rule criterion continuous concentration for copper.
4. Two of 16 samples exceeded the effects range median for copper for surface sediment samples and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy. However, current conditions have changed due to the new shallow water habitat created in Cabrillo Beach area and may no longer be negatively impacted due to copper.
5. Zero of two of the samples listed in newer data, LOE 28224, shows no copper exceedences, and does not exceed the allowable frequency listed in Table 4.1
6. One of 14 samples were either moderately or highly toxic; however these sample results were historic (1992) and more recent sediment results (1993-1997) did not show elevated copper levels.
7. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
