Regional Board Conclusion:	This pollutant is being considered for removal from the section 303(d) list under section 4.2 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. Eight lines of evidence are available in the administrative record to assess this pollutant. Six of 58 samples exceed the Cold Freshwater Habitat objective and none of the 58 samples exceed the objective for Warm Freshwater Habitat. The Basin Plan general water quality objective for oxygen saturation states that the median value shall not fall below 85% saturation. Furthermore, the objective is only applied ¿for waters not mentioned by a specific beneficial use¿¿ and this waterbody is designated for both Cold and Warm Water Habitats. Therefore, the use support rating for this pollutant is set at insufficient information. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Six of 58 samples exceed the Cold Freshwater Habitat objective and none of the 58 samples exceed the objective for Warm Freshwater Habitat and this does not exceed the allowable frequency listed in Table 4.2 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the section 303(d) list because applicable water quality standards for the pollutant are not being exceeded.

Regional Board Conclusion:	This pollutant is being considered for removal from the section 303(d) list under section 4.1 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. The pollutant name for this decisions has been changed to Toxicity. In previous listing cycles, separate fact sheets were developed for Sediment Toxicity and Unknown Toxicity (AKA water toxicity). In this current assessment cycle, those two fact sheets and all of the associated LOEs are combined into this single fact sheet for Toxicity. This water body segment was on the 2010-303(d) List for both water and sediment toxicity. Fourteen lines of evidence are available in the administrative record to assess this pollutant. One sample can have multiple toxicity test results (or endpoints) but will be counted only once. One sample is defined as being collected on the same day at the same location. Ten LOEs summarize water samples. Seven samples are summarized in LOEs using each of the test organisms as the pollutant name (i.e. plant toxicity, invertebrate toxicity or vertebrate toxicity) and 11 additional samples are summarized in LOEs using the pollutant name ¿toxicity¿. Therefore, 18 total samples are available to assess this pollutant. Four of the 18 samples resulted in a significant toxic effect to one or more test organisms and therefore exceed the water quality objective for aquatic life protection. All four of the samples exhibited significant toxicity to survival and/or reproduction of Ceriodaphnia dubia and one of the samples also exhibited significant toxicity (reduced cell growth) to the algae Selenastrum. Four lines of evidence are available in the administrative record to assess toxicity in sediment samples. Three samples are summarized in LOEs with the test organism name as the pollutant (i.e. invertebrate toxicity) and three additional samples summarized in LOEs with the pollutant name ¿toxicity¿. Therefore, six total samples are available to assess this pollutant. Two of the 6 samples were toxic to invertebrate test organisms (exhibited a significant increase in mortality compared to the laboratory control) and therefore exceed the narrative water quality objective for toxicity, set to protect for aquatic life beneficial uses. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. However, there is insufficient justification to place it in the Being Addressed portion of the CWA 303(d) List because although a TMDL has been completed and approved by RWQCB and USEPA for water toxicity (formerly called Unknown Toxicity on the 303(d) List), and is expected to result in attainment of the standard there is not yet an approved TMDL for sediment toxicity. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Four of the 18 water samples and two of the six sediment samples resulted in a significant toxic effect to one or more test organisms and therefore exceed the water quality objective for aquatic life protection and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

The samples exhibited significant toxicity to survival and reproduction of Ceriodaphnia dubia. The sample from 2/6/09 resulted in complete mortality to Ceriodaphnia dubia within 24 hours. The toxicity tests for the samples included survival and reproduction of Ceriodaphnia dubia, survival and growth of Pimephales promelas and total cell count (growth) of Selenastrum capricornutum. Regional Board Conclusion:	This pollutant is being considered for removal on the CWA section 303(d) List under sections 2.2 and 4.1 of the Listing Policy. Under section 4.1 of the Policy, a minimum of one line of evidence is needed to assess listing status. Eleven lines of evidence are available in the administrative record to assess this pollutant. Five of the 6 nitrate samples exceed the water quality objectives for the Agriculture beneficial use. Eighteen of the 18 nitrate samples and 17 of the 19 nitrate/nitrite samples exceed the water quality objective for the Municipal and Domestic Supply beneficial use. Eighteen of the 18 nitrate samples and all 36 nitrate/nitrite samples exceed the evaluation guideline (Central Coast Region Technical Report, 2010) for Cold and Warm Freshwater Habitat. In addition, the following evidence supports the conclusion that nitrate contributes to or causes a bio stimulatory effect in this water segment. 1) Dissolved oxygen for this water body ranged from 5.03 mg/L to 17.7 mg/L, often exceeding (falling below) the Cold freshwater habitat objective and at times exceeding the upper dissolved oxygen screening of 13.0 mg/L (R3 NNE Technical Report, 2010). 2) Water column chlorophyll a concentration ranged from 0.0 to 50 ug/L, at times exceeding screening threshold of 15 ug/L (R3 NNE Technical Report, 2010). 3) Using site-specific data from this waterbody, the California Benthic Biomass Predictor Tool, v. 13 (Tetratech, 2007) predicted a benthic algal contribution to oxygen deficit for this water body of 3.69 mg/L. This exceeds the screening threshold for benthic algal contribution to oxygen deficit of 1.25 mg/L (R3 NNE Technical Report, 2010). 4) Using site-specific data from this waterbody, the California Benthic Biomass Predictor Tool, v. 13, QUAL2K model (Tetratech, 2007) predicted algae biomass of 88 g/m2 ash-free dry weight (AFDW). This exceeds the Cold water screening threshold for algae biomass of 60 grams/m2 and the warm water screening threshold of 80 grams/m2, respectively (Creager, et al., 2006). 5) Using site-specific data from this waterbody, the California Benthic Biomass Predictor Tool, v. 13 (Tetratech, 2007) predicted a benthic chlorophyll a concentration of 219 mg/m2. This exceeds the Cold water screening threshold of 150 mg/m2 and the Warm water screening threshold of 200 mg/m2 (Creager, et al., 2006). Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. In accordance with section 2.2 of the Policy, there is sufficient justification to place it in the Being Addressed portion of the CWA 303(d) List because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Five of the 6 nitrate samples exceed the water quality objectives for the Agriculture beneficial use. Eighteen of the 18 nitrate samples and 17 of the 19 nitrate/nitrite samples exceed the water quality objective for the Municipal and Domestic Supply beneficial use. These all exceed the allowable frequency listed in Table 4.1 of the Listing Policy. 4. Eighteen of the 18 nitrate samples and all 36 nitrate/nitrite samples exceed the evaluation guideline for Cold and Warm Freshwater Habitat and there is evidence in support of the conclusion that nitrate contributes to or causes a bio stimulatory effect in this water segment. 5. The Lower Salinas River Watershed Nutrient TMDL has been approved by USEPA on 10/13/2015. 6. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

State Board Review of Regional Board Conclusion and Recommendation:	This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Five of the 6 nitrate samples exceed the water quality objectives for the Agriculture beneficial use. Regional Board Conclusion:	This pollutant is being considered for placement on the section 303(d) list under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. Four lines of evidence are available in the administrative record to assess this pollutant. None of the 57 samples exceed the Evaluation Guideline (North Carolina Administrative code, Title 15A) and the General Water Quality Objective set to protect aquatic life beneficial uses. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. None of the 57 samples exceed the Evaluation Guideline (North Carolina Administrative code, Title 15A) and the General Water Quality Objective set to protect aquatic life beneficial uses. This does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy. 4. Regional Board Conclusion:	This pollutant is being considered for placement on the section 303(d) list under sections 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status. Five lines of evidence are available in the administrative record to assess this pollutant. Zero of the five samples exceed the evaluation guideline (Siepmann and Finlayson 2000, with minor corrections to significant figures as described in Beaulaurier et al., 2005) applied to protect for aquatic life beneficial uses. Zero of the three samples exceed the USEPA drinking water health advisory. This sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is supported using table 3.1. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List in the Water Quality Limited Segments category. Regional Board Conclusion:	This pollutant is being considered for placement on the section 303(d) list under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant. Twenty-five of the 32 samples exceed the evaluation guideline used to interpret the water quality objective established to protect for Cold Water Habitat and 19 of the 32 samples also exceeded the evaluation guideline used to interpret the water quality objective established to protect for Warm Water Habitat. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Twenty-five of the 32 samples exceed the evaluation guideline used to interpret the water quality objective established to protect for Cold Water Habitat and 19 of the 32 samples also exceeded the evaluation guideline used to interpret the water quality objective established to protect for Warm Water Habitat. Each of these exceeds the allowable frequency listed in Table 3.2 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Conclusion:	The pollutant name was changed to ¿Ammonia¿ in the 2014 assessment cycle. This decision replaces the two previously approved decisions, one for each of the pollutants unionized ammonia and total ammonia. This decision contains all of the LOEs from those decisions in addition to new LOEs. This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status. Six lines of evidence (LOEs) are available in the administrative record to assess this pollutant. Four LOEs summarize unionized ammonia data and two aquatic life beneficial uses. Five of 56 samples exceed the Basin Plan general objective for unionized ammonia set to protect aquatic life. Two LOEs summarize total ammonia data and none of 60 samples exceed the EPA's Lifetime Health advisory level for total ammonia in drinking water. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.In accordance with section 2.2 of the Policy, there is sufficient justification to place it in the Being Addressed portion of the 303(d) list because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Five of 56 samples exceed the water quality objective for unionized ammonia and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. 4. The Lower Salinas River Watershed Nutirent TMDL has been approved by the Central Coast Water Board in 2013 and approved by USEPA on 10/13/2015. 5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Conclusion:	This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status. Five lines of evidence are available in the administrative record to assess this pollutant. Two of the 5 samples exceed the evaluation guideline (Finlayson, 2004) applied to protect for aquatic life beneficial uses. Zero of the three samples exceed the USEPA drinking water health advisory.This sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is supported using table 3.1. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification to place it in the Being Addressed portion of the 303(d) list because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Two of the 5 samples exceed the evaluation guideline (Finlayson, 2004)applied to protect aquatic life beneficial uses and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. 4. The Lower Salinas Watershed Chlorpyrifos and Diazinon TMDL was approved by the USEPA on 10/7/2011. 5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be placed on the section 303(d) list because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem. Furthermore, this pollutant waterbody combination should be placed in the 'Being Addressed' portion of the 303(d) list because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard.
