Regional Board Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under section 4.11 of the Listing Policy. Under this section when all other delisting factors do not result in the delisting of a water segment but information indicates attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates that water quality standard is attained. If the weight of evidence indicates attainment, the water segment shall be removed from the CWA section 303(d) List.

LOEs 45088 and 47495 are replaced with LOE 132985.
LOEs 47589 and 47590 are replaced with LOE 133937.
LOEs 132985 and 133937 are reassessments of the same data according to the mercury objectives.

Seven lines of evidence are available in the administrative record to assess mercury concentrations in fish fillets.

WILD beneficial use: LOEs 132937, 133189 and 133939 combined represent 3 of 3 samples that exceed the sportfish objective of 0.2 mg/kg. Zero of 1 sample exceeds according to the prey fish objective of 0.05 mg/kg in LOE 133093.

COMM beneficial use: LOEs 132985, 133305 and 133937 combined represent 4 of 4 samples that exceed the sportfish objective of 0.2 mg/kg. Fish used in the COMM assessment are limited to lengths that are within Calif. Dept. of Fish and Wildlife legal size limits applicable to this waterbody.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List.
This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. Three of 3 samples exceed the sportfish objective for WILD and 4 of 4 samples exceed the sportfish objective for COMM and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. A minimum of 3 annual averages based on composite fish tissue samples must meet the standard in order to indicate attainment of the standard.
3. This process is scientifically defensible and reproducible.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

Data Used to Assess Water Quality: Nine out of 16 samples exceeded the evaluation guideline. Each sample was comprised of a composite of 1-6 fish. Seven filet composites of largemouth bass, 4 filet individual samples of channel catfish, 2 filet individual samples of rainbow trout, 2 filet composite redear sunfish, and 1 individual sample of striped bass were collected. Largemouth bass were collected in 1993, 2000-01, channel catfish, rainbow trout, striped bass in 2001,and redear sunfish in 1992-93. This LOE re-assesses data from LOE 667 from the 2006 Integrated Report cycle in order to update the evaluation guideline.

Evaluation Guideline: The USEPA 304(a) recommended water quality criterion for concentrations of methylmercury in fish tissue of trophic level 4 fish (150 - 500 mm; fillet wet weight) is 0.20 mg/kg. Total mercury is usually analyzed for most fish studies and assumed to be 100 percent methylmercury for the purposes of risk assessment (Klasing & Brodberg 2008). The fish consumption rate of 32 grams/day is considered more protective of human health since recommendations are now to eat 1 meal a week of fish to obtain necessary Omega 3 nutrition.
