Regional Board Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under section 4.5 and 4.11 of the Listing Policy. Under section 4.5 a single line of evidence is necessary to assess listing status. Under section 4.11 when all other delisting factors do not result in the delisting of a water segment but information indicates attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates that water quality standard is attained. If the weight of evidence indicates attainment, the water segment shall be removed from the CWA section 303(d) List.

Nine LOEs were replaced as follows::
1) LOEs 31046 and 63258 are replaced by LOE 226190;
2) LOEs 22542 and 95479 are replaced by LOE 227472;

4) LOEs 22411 and 95482 are replaced by LOE 227036.

The replacing LOEs are reassessments of the same data in the respective older LOEs following the statewide mercury objectives adopted in 2017.

LOE 223774: 1 of 1 samples exceed the mercury objective and consist of 20 prey fish sampled from a mixture of trophic levels and collected between February and July of the same calendar year.
LOE 227443: 1 of 1 samples exceed the mercury objective and consist of 6 prey fish sampled from a mixture of trophic levels and collected between February and July of the same calendar year.
LOE 227444: 1 of 1 samples exceed the mercury objective and consist of 6 prey fish sampled from a mixture of trophic levels and collected between February and July of the same calendar year.

WILD beneficial use (sport fish objective):

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Tissue samples were compared with the sport fish objective and 5 of 6 samples exceed for WILD beneficial use and 5 of 6 samples exceed for the COMM beneficial use. The samples consist of trophic level 4 fish and are from a minimum of 2 annual averages and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. In addition, tissue samples were compared with the prey fish objective and 3 of 3 samples exceed for WILD beneficial use. Samples may consist of a mix of trophic levels and are from a minimum of 2 annual averages and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy.
A minimum of 3 annual averages based on composite fish tissue samples must meet the standard to indicate attainment of the standard.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.

Two lines of evidence are available in the administrative record to assess this pollutant. Zero of the one samples exceed the evaluation guideline for WARM, and zero of the one samples exceed the evaluation guideline for COMM.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
