Implementation Action Other than TMDL: Natomas East Main Drainage Canal (aka Steelhead Creek, downstream of confluence with Arcade Creek) is primarily an urban drain. Site was listed in the Basin Plan Amendment for the Control of Diazinon and Chlorpyrifos Discharges Final Staff Report, 2014. Sampling indicated that it is no longer impaired due to a reduction of Diazinon in urban settings and updated management practices.

Regional Board Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under section 4.1 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.

Three lines of evidence are available in the administrative record to assess this pollutant. Zero of the 28 samples exceeded the evaluation guideline.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Zero of the 28 samples exceeded the evaluation guideline and this does not exceed the allowable frequency listed in Table 4.1 of the Listing Policy.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under section 4.5 and 4.11 of the Listing Policy. Under section 4.5 a single line of evidence is necessary to assess listing status. Under section 4.11 when all other delisting factors do not result in the delisting of a water segment but information indicates attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates that water quality standard is attained. If the weight of evidence indicates attainment, the water segment shall be removed from the CWA section 303(d) List.

Four lines of evidence are available in the administrative record to assess the pollutant.
LOEs 22628 and 95513 are replaced with LOE 227588. LOEs 22629 and 95516 are replaced with LOE 227544. The current LOEs are a reassessment of the same data following the statewide mercury objectives adopted in 2017.

WILD beneficial use (sport fish objective):
LOE 227563: 1 of 1 samples exceed the mercury objective and consist of 6 trophic level 3 fish. Fish lengths are within CDFW length limits.
LOE 227572: 3 of 3 samples exceed the mercury objective and consist of 25 trophic level 4 fish. Fish lengths are within CDFW length limits.

COMM beneficial use (sport fish objective):

3. Tissue samples were compared with the sport fish objective and 3 of 3 samples exceed for WILD beneficial use and 3 of 3 samples exceed for the COMM beneficial use. The samples consist of trophic 4 fish and are from a minimum of 2 annual averages and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy.
1 of 1 samples exceed for the WILD beneficial use and 1 of 1 samples exceed for the COMM beneficial use for trophic level 3 fish that are annual averages and are aggregated from at least eight fish. Eight or more fish within a sample are needed to determine non-attainment of the mercury objective following weight of evidence in Listing Policy section 3.11.
A minimum of 3 annual averages based on composite fish tissue samples must meet the standard to indicate attainment of the standard.

Regional Board Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status.

Two lines of evidence are available in the administrative record to assess this pollutant for Water Contact Recreation. Twenty of the 22 samples exceed the objective, expressed as a six-week rolling geometric mean, for the protection of the Water Contact Recreation use. Seven of the eleven samples exceed the objective, expressed as a statistical threshold value, for the protection of the Water Contact Recreation use.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.

Regional Board Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under section 3.11 of the Listing Policy. Under this section when all other listing factors do not result in the listing of a water segment but information indicates non-attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates that water quality standard is not attained. If the weight of evidence indicates non-attainment, the water segment shall be placed on the CWA section 303(d) List.

Three lines of evidence are available for this assessment. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification to place this water segment-pollutant combination on the CWA section 303(d) List. This conclusion is based on the staff findings that:

1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The following information indicates that the water quality standard is not being attained: Trash is considered a nuisance pollutant for non-contact recreation as described in the Water Quality Control Plan for the California Regional Water Quality Control Board Central Valley Region, Sacramento and San Joaquin River Basins; Fifth Edition, Revised May 2018 (Basin Plan).
Natomas East Main Drainage Canal (aka Steelhead Creek, downstream of confluence with Arcade Creek) was assessed and cleaned up on four separate events which occurred between August 2018 and November 2018. Each event was documented with photos and the amount of trash removed. The trash removal was conducted at Steelhead Creek at West El Camino Bridge and approximately 550 ft downstream on 8/23/18, 8/30/18, 11/6/18, and 11/8/18. Each event recorded weight of trash removed. An average of 36 tons were removed per event and a total of 181 tons of trash was removed over the five separate events. The photographic evidence demonstrates nuisance conditions and the impairment of the Non-Contact Recreation (REC-2) beneficial use.
Each subsequent trash removal event, which occurred in the same general location, was warranted due to additional trash accumulation. Due to continual trash accumulation, trash removal events are now scheduled yearly, indicating a persistent problem with trash pollution in this waterbody.
3. This process is scientifically defensible and reproducible. Each trash removal event consisted of trash removal and photographic evidence of trash in the river and along the riverbank. Photographs were taken before and after the trash was removed. The amount of trash removed was recorded.
