Regional Board Conclusion: Benthic Community Effects is being considered for placement on the section 303(d) list under sections 3.9 and 3.1 of the Listing Policy. Under section 3.9, an additional line of evidence associating Benthic Community Effects with a water or sediment concentration of pollutant(s) is necessary to assess listing status.

One line of evidence is available in the administrative record to assess this indicator. Two of the 4 benthic invertebrate samples exceed (fall below) the Southern California IBI threshold for poor community composition.

No pollutants are exceeding water quality criteria at a frequency that indicates beneficial use impairment due to a pollutant. Therefore this water body segment cannot be placed onto the 303(d) List as defined in Section 3.9 of the Listing Policy. However, there is evidence that indicates beneficial uses may be potentially threatened.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Two of 4 samples were below the Index of Biological Integrity (IBI) value of 39 which indicated poor benthic invertebrate community structure. Although the data indicates beneficial uses may be potentially threatened, pollutants could not be directly associated with the Benthic Community Effects and therefore, in accordance with Section 3.9 of the Listing Policy the waterbody and pollutant combination should not be placed on the 303(d) List.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

The California Stream Condition Index is a new scoring tool for bioassessment data that is applicable statewide, accounts for a much wider range of natural variability, and provides equivalent scoring thresholds in all regions of the state. The CSCI has been used in some assessments this reporting cycle and will be used in the future for water quality assessment purposes statewide over the regional indices of biologic integrity (IBIs). If CSCI scores have not be calculated for data and only IBI scores are available, IBI scores will still be used to interpret the data.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the Section 303(d) List.
