Regional Board Staff Conclusion:	This pollutant is being considered for removal from the CWA section 303(d) List under section 4.2 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. Five lines of evidence, two which assess E. coli data against the REC-1 beneficial use, two which assess fecal coliform data against the MUN beneficial use and one which assesses fecal coliform data against the REC-1 beneficial use are available in the administrative record to assess this pollutant. This decision is based primarily on E. coli geometric mean data, but all other data assessments also indicate that the waterbody is achieving its designated beneficial uses: 0 of 27 samples exceed the water quality objective for E. coli assessed against the REC-1 beneficial use using both the geometric mean and the statistical threshold value; 0 of 25 samples exceed the water quality objective for fecal coliform assessed against the MUN beneficial use; 3 of 103 samples exceed the objective for fecal coliform as assessed against the REC-1 beneficial use. Also of note, in past cycles bacteria data have been assessed under the pollutants 'Pathogens' and 'Fecal Coliform'. During this (2018) cycle, the decision pollutant name has been changed to 'Indicator Bacteria' to reflect the fact that these organisms are indicators of the likely presence of pathogens rather than being pathogenic or harmful to humans themselves. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. [NUMBER] of [NUMBER] samples exceeded the [OBJECTIVE/GUIDELINE/CRITERIA] and this does not exceed the allowable frequency listed in Table 4.2 of the Listing Policy. 4. This assessment uses data collected and analyzed by Lahontan RWQCB staff in 2000, 2001, 2002, 2003, 2004 and 2008. It focuses on violations of the 20/100 mL limit. Data were evaluated as 30-day normalized log means. For the six years of sampling there were 103 log mean datapoints and 3 datapoints in violation of the 20/100 mL limit.

"Waters shall not contain concentrations of coliform organisms attributable to anthropogenic sources, including human and livestock waste.

The fecal coliform concentration during any 30-day period shall not exceed a log mean of 20/100 ml, nor shall more than 10 percent of all samples collected during any 30-day period exceed 40/100 ml. The log mean shall ideally be based on a minimum of not less than five samples collected a evenly spaced as practicable during any 30-day period. However, a log mean concentration exceeding 20/100 ml for any 30-day period shall indicate violation of this objective even if fewer than five samples were collected."

Environmental Conditions:

The Upper Truckee River is the largest tributary of Lake Tahoe. Its watershed above Christmas Valley is National Forest land and includes a popular hiking/mountain biking/cross country skiing trail. Range livestock grazing under a U.S. Forest Service permit occurred in the watershed prior to 2000. The permit was subsequently revoked.

Regional Board Staff Conclusion:	This pollutant was considered for placement on the section 303(d) list in a previous assessment cycle. 303(d) listing decisions made prior to 2006 were not held in an assessment database. Based on these prior assessments, this pollutant/waterbody combination was placed on the 303(d) list prior to 2006. New data were assessed this (2018) cycle and the decision is as follows: This pollutant is being considered for removal on the CWA section 303(d) List under sections 2.2 and 4.1 of the Listing Policy. Under 4.1 of the Policy, a minimum of one line of evidence is needed to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. There is sufficient justification to place it in the Being Addressed portion of the CWA 303(d) List because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. CSCI scores range from 0 (highly degraded) to greater than 1 (equivalent to reference). Physical characteristics of a site vary due to both natural factors and human disturbance. Statistical models based on a large statewide reference data set can help distinguish natural variability from anthropogenic stress. These models work across the diverse stream types found in California. The Index of Physical Habitat Integrity (IPI) is a multimetric Index developed based on these models to characterize physical habitat condition for streams in California. Index scores near 1 indicate physical habitat conditions similar to reference, whereas lower scores indicate degradation. For the purposes of making statewide assessments, three thresholds (analogous to those used for the CSCI) were established based on the 30th; 10th; and 1st percentiles of IPI scores at reference sites. These three thresholds divide the IPI scoring range into 4 categories of physical condition as follows: greater than or equal to 0.94 = likely intact condition; 0.93 to 0.84 = possibly altered condition; 0.83 to 0.71 = likely altered condition; less than or equal to 0.70 = very likely altered condition. Scores of 0.83 lower indicate that the physical habitat has been altered and low CSCI scores from this site may be due to impacts to the physical habitat.
