Regional Board Staff Conclusion: There is sufficient justification to delist this waterbody/pollutant because when the Dominguez Channel and Los Angeles and Long Beach Harbors Toxics and Metals was completed, the TMDL analysis showed no diazinon concentrations above the guideline, post 2005.

This conclusion is based on the staff findings that:
1. The Dominguez Channel and Los Angeles and Long Beach Harbors Toxics and Metals TMDL was approved by USEPA on 03/23/2012.
2. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Even though fecal coliform is no longer the applicable indicator bacteria for fresh waters in the Los Angeles Region, studies show (Noble et al., 2003) that 80 to 90% of fecal coliform are E coli in the Los Angeles Region, and therefore the fecal coliform data used to list this waterbody is a reasonable stand in for E coli until E coli data is available. This conservative approach will limit the potential for delisting this waterbody which data has shown to be impaired for fecal indicating bacteria.

The aquatic life criteria will vary depending of total hardness reported at the sampling site. The CCC for dissolved copper is the highest concentration to which aquatic life can be exposed for an extended period of time (e.g., four days) without deleterious effects. The CMC for dissolved copper is the highest concentration to which aquatic life can be exposed for a short period of time (e.g., one hour) without deleterious effects. Evaluation Guideline: The chronic toxicity of the effluent is expressed and reported in Chronic Toxic Units, where,TUc = 100/NOEC or LC50 or EC50, as determined by the results of a critical lifestage toxicity. Toxicity is usually defined as the statistically significant difference from control using a t-test or other valid statistical tests. Spatial Representation: Samples were taken at the Dominguez Channel Monitoring Station (S23) which is located within the Dominguez Channel/Los Angeles Harbor watershed in Lennox, near Los Angeles International Airport (LAX). The monitoring station is near the intersection of 116th Street and Isis Avenue. The overall watershed land use is predominantly transportation, and includes areas of LAX and Interstate 105.
Temporal Representation: Samples were taken in October 2000, and in January through April 2001.
Environmental Conditions: According to the County of Los Angeles, Department of Public Works, Stormwater Monitoring Reports, 2000-2001 Monitoring Report samples were taken during storm events, the amount of rainfall was not noted.
