IMPLEMENTATION OF THE ENERGY POLICY ACT OF 2005
EPA Evaluation of California UST Leak Prevention Program
In February 2014, U.S. Environmental Protection Agency (USEPA) Region 9 evaluated the compliance of the California State Water Resources Control Board (State Water Board) in implementing the underground storage tank (UST) provisions of the Energy Policy Act (EPAct) of 2005. This was accomplished by reviewing records, procedures, and regulations within the State Water Board’s UST Leak Prevention Program, as well as evaluating field inspections throughout California.
The result of the evaluation not only validated the State Water Board’s compliance with implementing the UST provisions of the EPAct, but it also displayed many high-performing aspects of the State Water Board’s UST Leak Prevention Program. The evaluation demonstrated California’s strengths in advance leak detection, well-trained inspectors, and streamlined comprehensive inspections, with some opportunities for enhancement. Below is the complete report of USEPA’s evaluation of California and a letter commending California’s significant work of implementing the UST Program in ways that meets and exceeds national standards.
