San Diego Region - Active Administrative Civil Liability Complaints

Notice of Settlement No. R9-2013-0107 and Opportunity for Public Comment, City of Oceanside, $3,000 Mandatory Minimum Penalty Administrative Civil Liability for two Settleable Solids violations of Order No. R9-2011-0016, Waste Discharge Requirements for the City of Oceanside, San Luis Rey Water Reclamation Facility, La Salina Wastewater Treatment Plant, and Mission Basin Desalting Facility Discharges to the Pacific Ocean via the Oceanside Ocean Outfall. 

On June 11, 2013, the City of Oceanside accepted the Prosecution Team’s settlement offer to pay $3,000 MMP ACL for the two permit violations.  The San Diego Water Board is soliciting public comment on the proposed settlement.  Public comments on the settlement are due no later than 5 p.m. on July 11, 2013.  Attention comments to Frank Melbourn via email at fmelbourn@waterboards.ca.gov or via facsimile to (858) 571-6972, or via U.S. mail to 9174 Sky Park Court, Suite 100, San Diego, CA 92123.

Complaint No. R9-2012-0014 for Administrative Civil Liability against the City of La Mesa, Sanitary Sewer Overflows to San Diego Bay via Chollas Creek and the Pacific Ocean via Alvarado Creek and the San Diego River

On December 13, 2012, the California Regional Water Quality Control Board, San Diego Region (San Diego Water Board) issued Complaint No. R9-2012-0014 against the City of La Mesa in the amount of $948,816 for violations resulting from the discharge of 1,008,000 gallons of raw sewage to San Diego Bay via Chollas Creek and 306,700 gallons of raw sewage to the Pacific Ocean via Alvarado Creek and the San Diego River on December 21 and 22, 2010.
