San Diego Region - Active Administrative Civil Liability Complaints

Settlement Agreement and Stipulation for Entry of Administrative Civil Liability Order No. R9-2015-0015, In the Matter of Jacobs Center for Neighborhood Innovation, Northwest Village Creek Construction Project, San Diego County.

On May 15, 2015, the San Diego Water Board Prosecution Team and Jacobs Center for Neighborhood Innovation (Parties) entered into an agreement to settle alleged violations of the National Pollutant Discharge Elimination System (NPDES) General Permit for Storm Water Discharges Associated with Construction and Land Disturbance Activities, Order No. 2009-0009-DWQ, NPDES No. CAS000002 (Construction Storm Water Permit) at the Northwest Village Creek Construction Project from December 4, 2014. To resolve the alleged violations without formal administrative proceedings, the Parties engaged in confidential settlement negotiations in accordance with the State Water Resources Control Board Enforcement Policy and its penalty calculation methodology, and ultimately agreed to the final imposition of an administrative civil liability totaling $46,718. Settlement Agreement and Stipulation for Administrative Civil Liability Order No. R9-2015-0048 against Eastern Municipal Water District for Sanitary Sewer Overflow identified January 3, 2013 from Temecula Valley, Riverside County

The San Diego Water Board Prosecution Team and Eastern Municipal Water District (District) have reached a tentative Settlement Agreement to address liability associated with the discharge of an estimated 3,829 to 132,663 gallons of raw sewage to French Valley Creek and downstream waters from the District's sanitary sewer collection system. The District identified and terminated the discharge on January 3, 2013. In the proposed settlement agreement, the District has agreed to the imposition of a civil liability totaling $110,624 with no Supplemental Environmental Project. Public comments will be accepted until May 27, 2015. Administrative Civil Liability Complaint No. R9-2013-0152 against the City of Encinitas and USS Cal Builders, Inc. for Violations of Construction and Municipal Storm Water Requirements from the Hall Property Park Project

UPDATE: The City of Encinitas and the San Diego Water Board Prosecution Team have reached a tentative Settlement Agreement to resolve the violations alleged and administrative civil liability recommended in Administrative Civil Liability Complaint No. R9-2013-0152. A 30-day public comment period has been established to receive comments from interested parties regarding the tentative Settlement Agreement. Public comments will be accepted until 5:00 p.m. on Wednesday, May 13, 2015. On November 21, 2013, the California Regional Water Quality Control Board, San Diego Region (San Diego Water Board) issued ACL Complaint No. R9-2013-0152 against the City of Encinitas and USS Cal Builders, Inc. in the amount of $430,851 for discharging sediment to the MS4, Rossini Creek and San Elijo Lagoon and related violations of Order No. 2009-0009-DWQ and for the City's failure to adequately implement the Jurisdictional Urban Runoff Management Program construction component of San Diego Water Board Order No. R9-2007-0001 during construction of the Hall Property Park. A public hearing has been tentatively scheduled for February 12, 2014.
