San Diego Region - Active Administrative Civil Liability Complaints

Complaint No. R9-2014-0074 for Administrative Civil Liability against San Diego CRV Center, 855 32nd Street, San Diego, California 92102, for Violation of Water Code Sections 13376, 13385, and 13399, State Water Board Order No. 97-03-DWQ, and federal Clean Water Act Section 301.

On July 28, 2014, the California Regional Water Quality Control Board, San Diego Region (San Diego Water Board) issued Complaint No. R9-2014-0074 against San Diego CRV Center in the amount of $6,189 for violations of Water Code sections 13376, 13385, and 13399, State Water Board Order No. 97-03-DWQ, and the federal Clean Water Act. On July 22, 2014, the California Regional Water Quality Control Board, San Diego Region (San Diego Water Board) issued Complaint No. R9-2014-0063 against Scrap Depot Collection, Recycling & Container Services in the amount of $11,194 for violations of Water Code sections 13376, 13385, and 13399, State Water Board Order No. 97-03-DWQ, and the federal Clean Water Act. Complaint No. R9-2014-0013 for Administrative Civil Liability against GM Materials Ready Mix, 6974 Mission Gorge Road, San Diego, California 92120, for Violation of Water Code Section 13376, State Water Board Order No. 97-03-DWQ, and federal Clean Water Act Section 301.

On May 30, 2014, the California Regional Water Quality Control Board, San Diego Region (San Diego Water Board) issued Complaint No. R9-2014-0013 against GM Materials Ready Mix in the amount of $17,744 for violations of Water Code section 13376, State Water Board Order No. 97-03-DWQ, and the federal Clean Water Act. Complaint No.R9-2014-0023 for Administrative Civil Liability against Bart's Iron Design, 25825 Las Vegas Avenue, Capistrano Beach, California, for Violations of State Water Board Order No. 93-07-DWQ

On July 22, 2014, the California Regional Water Quality Control Board, San Diego Region (San Diego Water Board) issued Complaint No. R9-2014-0023 against Bart's Iron Design in the amount of $15,242 for violations of State Water Board Order No. 97-03-DWQ. A hearing before the San Diego Water Board is tentatively scheduled for October 15, 2014. Proposed Settlement Agreement and Stipulation for Entry of ACL Order No. R9-2014-0017, and Time Schedule Order No. R9-2014-0034 with the City of San Diego, in the matter of violations of Municipal Storm Water Permits 2001-01 and R9-2007-0001.

On May13, 2014 the California Regional Water Quality Control Board, San Diego Region (San Diego Water Board) issued a proposed Settlement agreement with the City of San Diego to address violations of Municipal Storm Water Permits 2001-01 and R9-2007-0001(MS4 Permits). Order No.R9-2014-0017 assesses liability for these violations in the amount of $949,634, of which $456,900 will be suspended upon completion of an Enhanced Compliance Action. Time Schedule Order No. R9-2014 -0034 proscribes the actions the City of San Diego must take to bring 150 non-compliant  public and private sites into compliance with MS4 Permit requirements.

Administrative Civil Liability Complaint No. R9-2013-0152 against the City of Encinitas and USS Cal Builders, Inc. for Violations of Construction and Municipal Storm Water Requirements from the Hall Property Park Project

UPDATE: The public hearing previously scheduled for February 12, 2014 has been postponed. A new 30 day public comment period will commence prior to this matter being heard before the San Diego Water Board. (Updated December 23, 2013)

On December 13, 2013 the San Diego Water Board’s Advisory Team issued Final Hearing Procedures that will govern the process for this proceeding unless/until they are suspended or modified by the San Diego Water Board through the Advisory Team. (Updated December 16, 2013)

On November 21, 2013, the California Regional Water Quality Control Board, San Diego Region (San Diego Water Board) issued ACL Complaint No. R9-2013-0152 against the City of Encinitas and USS Cal Builders, Inc. in the amount of $430,851 for discharging sediment to the MS4, Rossini Creek and San Elijo Lagoon and related violations of Order No. 2009-0009-DWQ and for the City’s failure to adequately implement the Jurisdictional Urban Runoff Management Program construction component of San Diego Water Board Order No. R9-2007-0001 during construction of the Hall Property Park.
