  • ACL Order R9-2010-00200 Assessment of $155,000 in civil liability against the San Diego Unified School District for failure to submit five semi-annual monitoring reports required by Order No. 97-11. On May 12, 2010, the San Diego Water Board accepted the School District’s offer to settle ACL Complaint R9-2009-0175 with a payment of $155,000.
  • ACL Order R9-2009-0172 On November 18, 2009, the Regional Board assessed an administrative civil liability of $680,278 against the City of San Diego for discharging 380,185 gallons of sewage into Lake Hodges in August 2007 in violation of Water Code section 13376.
  • ACL Order R9-2009-0168 Assessment of $70,680 in civil liability against the City of Laguna Beach for a 591,000 gallon sanitary sewer overflow in violation of State Board Order No. 2006-0003-DWQ. On November 18, 2009, the Regional Board accepted the City’s waiver of a public hearing and payment of $70,680.
  • ACL Order R9-2009-0160 Assessment of $1,600 in civil liability against GMG Stone, Inc. for failure to submit the Fiscal Year 2007-08 annual monitoring report required by State Board Order No. 97-03-DWQ. On October 14, 2009 the Regional Board imposed a penalty of $1,600 required by California Water Code Section 13399.33.
  • ACL Order R9-2009-0161 Assessment of $1,600 in civil liability against Progressive Steel Fabricators, Inc. for failure to submit the Fiscal Year 2007-08 annual monitoring report required by State Board Order No. 97-03-DWQ. On October 14, 2009 the Regional Board imposed a penalty of $1,600 required by California Water Code Section 13399.33.
  • ACL Order R9-2009-0162 Assessment of $1,600 in civil liability against E & E Transportation, Inc. for failure to submit the Fiscal Year 2007-08 annual monitoring report required by State Board Order No. 97-03-DWQ. On October 14, 2009 the Regional Board imposed a penalty of $1,600 required by California Water Code Section 13399.33.
  • ACL Order R9-2009-0084 Assessment of $61,200 in civil liability against William and Heidi Dickerson, Lawrence and Penelope Gunning, and Perry and Papenhausen, Inc. to resolve ACL Complaint R9-2008-0019 (8 alleged violations of the General NPDES Dewater Permit) and alleged violation of the Basin Plan, the Clean Water Act, and Water Quality Certification No. 05C-041.
  • ACL Order R9-2009-0048 Administrative assessment of mandatory minimum penalties against South Orange County Wastewater Authority in the amount of $204,000 for violations of effluent limitations in NPDES Order No. R9-2006-0054 from the South Coast Water District Groundwater Recovery Facility, Dana Point. On July 1, 2009, The Regional Board imposed a mandatory minimum penalty of $204,000 required by California Water Code Section 13385.
  • ACL Order R9-2009-0075 for Mandatory Minimum Penalties against Mountain Water Ice, Co. in the amount of $243,000 for violations of effluent limitations within NPDES Order No. R9-2005-0015 in discharges to the San Luis Rey River, Oceanside. The Regional Board imposed a mandatory minimum penalty of $243,,000 required by California Water Code Section 13385.
  • ACL Order R9-2009-0043 for Mandatory Minimum Penalties against North County Transit District in the amount of $15,000 for violations of violations of effluent limitations prescribed in Order No. R9-2001-0096, NPDES No. CAG919002, General Waste Discharge Requirements for Groundwater Extraction Waste Discharges From Construction, Remediation, and Permanent Groundwater Extraction Projects to Surface Waters Within the San Diego Region Except for San Diego Bay. The Regional Board imposed a mandatory minimum penalty of $243,,000 required by California Water Code Section 13385.
  • ACL Order R9-2009-0022 for Mandatory Minimum Penalties against Studio 15 Housing Partners In the amount of $42,000 for violations of effluent limitations prescribed in Order 2000-90, NPDES No. CAG919001, General Waste Discharge Requirements for Temporary Groundwater Extraction and Similar Waste Discharges to San Diego Bay and Storm Drains or Other Conveyance Systems Tributary Thereto. The violations occurred in discharges to San Diego Bay from the Studio 15 residential construction project in downtown San Diego. The Regional Board imposed a mandatory minimum penalty of $42,000 required by California Water Code Section 13385.
  • ACL Complaint R9-2009-0019 for Mandatory Minimum Penalties against America Plaza Owners Association In the amount of $12,000 for violations of effluent limitations prescribed in Order 2000-90, NPDES No. CAG919001, General Waste Discharge Requirements for Temporary Groundwater Extraction and Similar Waste Discharges to San Diego Bay and Storm Drains or Other Conveyance Systems Tributary Thereto. The violations occurred in discharges to San Diego Bay from One America Plaza building in downtown San Diego. The Regional Board imposed a mandatory minimum penalty of $12,000 required by California Water Code Section 13385.
  • ACL Order No. R9-2009-0003 for Mandatory Minimum Penalties against the City of Escondido, Hale Avenue Resource Recovery Facility. The Regional Board adopted a settlement agreement imposing civil liability of $1,335,000 in mandatory minimum penalties required by California Water Code Section 13385 for Violations of Order No. 99-72, NPDES No. CA0107981, Waste Discharge Requirements for the City of Escondido, Hale Avenue Resources Recovery Facility, Discharge to the Pacific Ocean Via the Escondido Land Outfall and the San Elijo Ocean Outfall and Order No. R9-2003-0394, NPDES No. CA0108944, Waste Discharge Requirements for the City of Escondido, Hale Avenue Resource Recovery Facility, Intermittent Wet Weather Discharge to Escondido Creek, San Diego County. The violations resulted from the treatment, transport, and disposal of sewage from the Hale Avenue Resource Recovery Facility.
  • ACL Order No. R9-2008-0134 against SFPP, L.P., an Operating Partnership of Kinder Morgan Energy Partners, L.P.
    in the amount of $222,000 was issued for violations of Order R9-2001-0096, NPDES Permit No. CAG919002, General Waste Discharge Requirements for Groundwater Extraction Waste Discharges from Construction, Remediation, and Permanent Groundwater Extraction Projects to Surface Waters within the San Diego Region Except for San Diego Bay. The Regional Board adopted an Order Assessing Administrative Civil Liability (ACL, which resolves violations alleged in the ACL Complaint No. R9-2008-0046. The Order includes a $93,000 mandatory minimum penalty and $129,000 in discretionary penalties pursuant to California Water Code Section 13385.
  • ACL Order No. R9-2008-0159 against Santa Margarita Water District for violation of Order R9-2007-0005, Waste Discharge Requirements for Sewage Collection Agencies in the San Diego Region. The Regional Board adopted an Order Assessing Administrative Civil Liability (ACL, which resolves violations alleged in the ACL Complaint No. R9-2008-0057. The order directs payment of $133,190 to the State Water Resources Control Board.
  • ACL Order No. R9-2008-0144 Against the South Orange County Wastewater Authority for violations of NPDES Permit No. CA 107417, Order Nos. R9-2000-13 and R9-2006-0054. The Regional Board adopted an Order Assessing Administrative Civil Liability (ACL), which resolved violations alleged in the ACL Complaint Nos. R9-2008-0090, R9-2008-0091, R9-2008-0092, and R9-2008-0094. The ACL included mandatory minimum penalties authorized by the California Water Code, Section 13385. The order directs: (1) payment of $12,500 to the State Water Resources Control Board; (2) payment of $37,500 to fund a Supplemental Environmental Project (SEP) known as “Harmful Algal Bloom Investigation” (Southern California Coastal Water Research Project).
  • Administrative Civil Liability Order No. R9-2008-0142 with mandatory minimum penalties in the amount of $135,000 to the San Diego County Water Authority for violations of Order No. 2001-96, NPDES Permit No. CAG919002, General Waste Discharge Requirements for Groundwater Extraction Waste Discharges from Construction, Remediation, and Permanent Groundwater Extraction Projects to Surface Waters within the San Diego Region Except for San Diego Bay.
  • ACL Order No. R9-2008-0140 against City of San Diego for violation of NPDES permit, Order No. R9-2003-0050. The Regional Board adopted an Order Assessing Administrative Civil Liability (ACL), which resolved violations alleged in the Conditional Early Settlement Offer No. R9-2008-0076. The ACL included mandatory minimum penalties authorized by the California Water Code, Section 13385. The order directs payment of $69,000 to the State Water Resources Control Board.
  • Administrative Civil Liability Order R9-2008-0137 with mandatory minimum penalties in the amount of $9,000 to the San Elijo Joint Powers Authority for violation Order R9-2005-0100, NPDES Permit No. CA0107999 Waste Discharge Requirement for the San Elijo Joint Powers Authority, San Elijo Water Reclamation Facility Discharge to the Pacific Ocean Via the San Elijo Ocean Outfall, San Diego County. The Order directs $4,500 of the penalty to a Supplemental Environmental Project to be conducted by the Southern California Coastal Waters Research Project.
  • Administrative Civil Liability Order No. R9-2008-0104 with mandatory minimum penalties in the amount of $9,000 to the Promenade Mall Development Corporation, for violations of Order No. 2001-96, NPDES Permit No. CAG919002, General Waste Discharge Requirements for Groundwater Extraction and Similar Waste Discharges from Construction, Remediation, and Permanent Groundwater Extraction Projects to Surface Waters Within the San Diego Region Except for San Diego Bay.
  • ACL Order No. R9-2008-0072 Against the Cities of Carlsbad and Vista for 7.3 Million Gallon Sewage Spill to Buena Vista Lagoon Settlement of Administrative Civil Liability (ACL) Complaint No. R9-2007-0099 against the Cities of Vista and Carlsbad for the discharge of 7.3 million gallons of untreated sewage from March 31 to April 3, 2007, from a 24-inch dia. sewer main at the Buena Vista Pump Station to Buena Vista Lagoon, San Diego County. The Regional Board adopted an Order Assessing Administrative Civil Liability in accordance with the terms of a settlement agreement between the Regional Board Prosecution Team and the Cities of Vista and Carlsbad. The ACL Order resolved violations alleged in the Complaint. The settlement includes: (1) payment of $200,000 to the State Water Resources Control Board; (2) payment of $500,000 to fund a Supplemental Environmental Project (SEP) in Buena Vista Lagoon; and (3) payment of $395,000 to fund a SEP in Buena Vista Creek.
  • ACL Order No. R9-2008-0068 Against North County Transit District (NCTD), Sprinter Rail Project . On June 11, 2008, the California Regional Water Quality Control Board, San Diego Region (Regional Board) adopted Administrative Civil Liability Order No. R9 2008-0068 against the North County Transit District (NCTD) in the amount of $685,000 for: 1) failure to implement adequate Best Management Practices (112 days at $5,000 per day), and 2) unregulated discharges of sediment to a Municipal Separate Storm Water System (MS4) and Waters of the United States (25 days at $5,000 per day) at the Sprinter Rail Project. On July 7, 2008, NCTD submitted payment in full, however on July 10, 2008, a member of the public petitioned the Regional Board action to the State Water Resources Control Board.
  • Vail Lake Settlement of Litigation: The Regional Board on November 8, 2006 (Item 13a), accepted a settlement agreement resolving litigation brought by WILLIAM P. JOHNSON, and VAIL LAKE USA, LLC in regards to Administrative Civil Liability Order No. R9-2002-0027.
