2006 CLEAN WATER ACT SECTION 303(d) LIST OF WATER QUALITY LIMITED SEGMENTS

New ! USEPA lists microcystin toxins for inclusion on California's 303(d) list for the Klamath River from the Oregon-California border to Iron Gate Dam

  • On March 13, 2008, USEPA reconsidered its prior approval of the State's 2006 303(d) list and has decided to add a listing for microcystin toxins for the Klamath River from the Oregon-California border, downstream to and including Iron Gate reservoir (Klamath River HU, Middle HA, Oregon to Iron Gate) located in the North Coast Region of the State.  If USEPA's final determination is to add this new listing, it will be considered part of the official 303(d) list for 2006.   At that time, a revised 2006 303(d) list and summary statistics table would be posted on our website.  Also note that any summary statistics involving number of listings etc., would increase by 1 for the number of water body/pollutant listings.  

  • USEPA plans to announce via Federal Register notice the availability of, and opportunity to comment on USEPA’s reconsideration and decisions regarding three segments of the Klamath River in California.  After the public comment period ends the USEPA will then review and consider all comments received and produce a response summary, followed by a final decision document.  For detailed information and specifics on the public comment period deadline, please access the following link to the USEPA Region 9 Water Program--Monitoring, Assessment and TMDLS at:  http://www.epa.gov/region09/water/tmdl/303d.html

Under Section 303(d) of the Clean Water Act, states, territories and authorized tribes are required to develop a list of water quality limited segments. These waters on the list do not meet water quality standards, even after point sources of pollution have installed the minimum required levels of pollution control technology. The law requires that these jurisdictions establish priority rankings for water on the lists and develop action plans, called as Total Maximum Daily Loads (TMDL), to improve water quality.

On June 28, 2007 the U.S. Environmental Protection Agency gave final approval to California's 2006 Section 303(d) List of Water Quality Limited Segments.

California's 303(d) List Structure

The California 303(d) Listing Policy sets the rules to identify which waters do not meet water quality standards. The Policy distinguishes between three categories of waters that do not meet water quality standards.  These categories basically describe the TMDL requirement status for each water body pollutant combination.  The categories are (1) waters still requiring a TMDL, and (2) waters where the water quality limited segment is being addressed.  Water segments in the “Water Quality Limited Segments Being Addressed” category must meet either of the following conditions:

  1. A TMDL has been developed and approved by USEPA and the approved implementation plan is expected to result in full attainment of the standard within a specified time frame; or
  2. It has been determined that an existing regulatory program is reasonably expected to result in the attainment of the water quality standard within a reasonable, specified time frame.

Posted below are 3 separate files distinguishing the categories and conditions described above.  Together they make up California’s entire CWA Section 303(d) list.  For your convenience, an additional table, that combines these 3 files, has been added to provide a more convenient means of working with the 2006 303(d) List.  The TMDL requirement status is identified in a specific column within this table.

    This portion of the section 303(d) list contains those waters and pollutants where the water quality problem must be addressed by a TMDL.
  • 2006 Clean Water Act Section 303(d) List of Water Quality Limited Segments Being Addressed By U.S.EPA Approved TMDLs
    This portion of the section 303(d)list contains those waters and pollutants where a TMDL has been approved and an implementation is available, but water quality standards are not yet met. This portion of the list is required by section 2.2(1) of the Listing Policy.
