Regional Board Staff Conclusion:	The impairment listing for pumping is being considered for delisting because the original listing was based on no data. The impairment is described in the 1996 water quality assessment, where it originally appeared, as not supporting aquatic life uses. A specific beneficial use, such as cold freshwater habitat or warm freshwater habitat, was not cited although later listing cycles associated the impairment with the warm freshwater habitat beneficial use. While no specific information was cited in the water quality assessment for Reach 3 in support of the listing, information from the draft Steelhead Restoration and Management Plan for California of 1995 (prepared by the California Department of Fish & Game and finalized in 1996) was cited for the same impairment in Reach 4, which is immediately upstream of Reach 3. However, there is no reference to any portion of Reach 3 in that document.

Regional Board Staff Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the impairment is due to a non-pollutant or pollution. This impairment therefore falls under Integrated Report Category 4c.

Under section 4.3 a single line of evidence is necessary to assess listing status. three lines of evidence are available in the administrative record to assess this pollutant. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. 8 of 18 single samples and 14 of 84 geometric mean calculations exceeded the Basin Plan Water Quality Objects for indicator bacteria in fresh water, and this exceeds the allowable frequency listed in Table 3.2 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

The Basin Plan bacteria objectives state that to protect water contact recreation in fresh waters individual samples shall not exceed the following limits: fecal coliform density shall not exceed 400/100 ml; and E. coli density shall not exceed 235/100 ml. Regional Board Staff Conclusion:	The impairment listing for diversions is being considered for delisting because the original listing was based on no data. The impairment is described in the 1996 water quality assessment, where it originally appeared, as not supporting aquatic life uses. A specific beneficial use, such as cold freshwater habitat or warm freshwater habitat, was not cited although later listing cycles associated the impairment with the warm freshwater habitat beneficial use. While no specific information was cited in the water quality assessment for Reach 3 in support of the listing, information from the draft Steelhead Restoration and Management Plan for California of 1995 (prepared by the California Department of Fish & Game and finalized in 1996)
