Dairy Settlement Agreements

  • Settlement Agreement and Stipulation for Entry of Administrative Civil Liability Order to resolve outstanding penalties for failure to file reports required by Waste Discharge Requirements General Order for Existing Milk Cow Dairies, Order No. R5-2007-0035. This agreement is posted for 30 day public review prior to approval. Discharger-Specific Order for Future Board Meetings

  • Kinder Morgan Energy Partners, L.P., (SFPP) Chico Terminal
    Kinder Morgan Energy Partners L.P. (SFPP, Discharger) owns and operates a 40-acre petroleum terminal at 2570 Hegan Lane, Chico, and is responsible for petroleum pollution. In 1997, the Executive Officer issued Cleanup and Abatement Order 97-711 (Order) to the Discharger, and in 2002 revised the Order. Due to the Discharger's actions, effective site cleanup and a contingency plan for nearby domestic wells in the Skyway Homes Subdivision, the California Regional Water Quality Control Board, Central Valley Region (Central Valley Water Board) intends to rescind the Order, and instead issue a Monitoring and Reporting Program.   • Red Barn, 656/980 State Highway 299 Bieber
    Red Barn, Discharger, is responsible for gasoline pollutants in groundwater from an underground storage tank system at 656/980 State Highway 299, Bieber, Lassen County. As an interim cleanup action, the Discharger proposes to extract polluted groundwater, treat effluent above-grade with a carbon filtration system, and route treated effluent into an on-site infiltration gallery under General Order R5-2003-0044.   • City of Alturas, Wastewater Treatment Plant
    On 9 September 2011, the Executive officer issued R5-2011-0591, an acl complaint for the mandatory minimum penalty (mmp) in the amount of $156,000 for the violations that occurred between July 2008 and March 2010 from the WWTP . On 3 October 2011 the Central Valley Water Board received a signed waiver of public hearing within 90 days and a request from the City to apply the civil liability towards a compliance project. On 10 November 2011 a draft administrative civil liability Order R5-2011-0596 was transmitted for public review to the City of Alturas. The draft Order contains the findings that the City meets the condition of a financial hardship, has completed a Compliance Project that corrected the violations that led to the issuance of the complaint, and the City expended funds in excess of the mandatory minimum penalty. The draft Order will be posted for 30 day public review prior to approval. Persons wishing to comment on this matter must submit their comments in writing to the Central Valley Water Board no later than 13 December 2011.       On May 8, 2012, the Assistant Executive Officer issued an Administrative Civil Liability Complaint R5-2012-0535 to City of Dunsmuir, Dunsmuir Wastewater Treatment Plant, Siskiyou County in the amount of $27,000 for violations of WDRs R5-2006-0129, which represent the sum of the statutory Mandatory Minimum Penalties for effluent violations between 1 December 2011 to 31 January 2012. This complaint is posted for 30 day public review. Persons wishing to comment on this matter must submit their comments in writing to the Central Valley Regional Water Quality Control Board no later than 27 June 2012.       On 15 November 2011 the Assistant Executive Officer of the Central Valley Water Board issued an amended administrative civil liability of $33,000 to Union Pacific Railroad Company for discharge violations from the Dunsmuir Railyard. These minimum mandatory penalties are for effluent violations that happen between July 2010 and July 2011.
