Administrative Civil Liability Notice of Hearings

Notice of December 10, 2008 Hearing on Administrative Civil Liability:

On December 10, 2008 the California Regional Water Quality Control Board, San Diego Region (Regional Board), will consider issuing orders imposing administrative civil liability for alleged violations in the following cases. In each case, the Regional Board will consider whether to approve, raise, lower, or reject the proposed assessment. The Regional Board may consider directing a portion of each recommended liability to supplemental environmental projects. Public hearings will be held unless the dischargers waive their rights to a hearing.

The Regional Board’s December 10, 2008 meeting will be at the Regional Board office at 9174 Sky Park Court, Suite 100, San Diego, CA. The meeting will begin at 9:00 a.m. Interested persons are invited to attend to express their views on the above items. Oral statements will be heard, but for accuracy of the record all important testimony should be in writing. To ensure that the Regional Board has the opportunity to fully study and consider written material, comments should be received in the Regional Board's office no later than 5:00 P.M. on Thursday, November 20, 2008. Written comments received after 5:00 P.M. on Wednesday, December 3, 2008, will not be considered by the Regional Board.

ACL Complaint R9-2008-0046, with mandatory minimum penalties (MMPs), to the SFPP. LP, an operating partnership of Kinder Morgan Energy Partners, LP, Mission Valley Terminal Dewatering Project, in the amount of $229,000 for alleged violations of Regional Board NPDES Order 2001-96.

ACL Complaint R9-2008-0080 to the City of San Marcos, Bradley Park Landfill, in the amount of $59,975 for alleged violations of Regional Board Investigative Order R9-2006-0044, as amended.

Complaint R9-2008-0057 against the Santa Margarita Water District in the amount of $133,190 for discharges of 887,934 gallons of untreated sewage to San Juan Creek and Cristianitos Creek from two incidents occurring in April and July 2007. The discharges were in violation of Order R9-2007-0005, Waste Discharge Requirements for Sewage Collection Agencies in the San Diego Region.
