Administrative Civil Liability Agreement with Tahoe Keys SMI, LLC to Settle Mandatory Minimum Penalties, El Dorado County
Overview
Discharges of storm water from the Tahoe Keys Marina are regulated under the Lahontan Water Board’s General Waste Discharge Requirements and National Pollutant Discharge Elimination System Permit for Storm Water Runoff Associated with Marina Operations in the Lake Tahoe Hydrologic Unit, Board Order No. R6T-2016-0038 (Marina General Permit).
The Lahontan Water Board’s Prosecution Team alleges that Tahoe Keys Marina is subject to $6,000 in mandatory minimum penalties for discharges of storm water to Lake Tahoe that exceeded effluent limitations found in the Marina General Permit. These violations took place on June 12, 2022.
Tahoe Keys SMI, LLC has agreed to settle the proposed penalty by (a) paying $6,000 to the State Water Pollution Cleanup and Abatement Account and (b) waiving its right to a public hearing. The Lahontan Water Board’s Prosecution Team has agreed to this proposal. The proposed settlement agreement was posted online for a 30-day public comment period. No comments were received. On June 6, 2025, the Lahontan Water Board’s Executive Officer Delegate, acting on behalf of the Lahontan Water Board, signed the Settlement Offer No. R6T-2025-0010 for expedited payment.
