Proposed Administrative Civil Liability Agreement with Tahoe Keys SMI, LLC to Settle Mandatory Minimum Penalties, El Dorado County
Overview
Discharges of storm water from the Tahoe Keys Marina are regulated under the Lahontan Water Board’s General Waste Discharge Requirements and National Pollutant Discharge Elimination System Permit for Storm Water Runoff Associated with Marina Operations in the Lake Tahoe Hydrologic Unit, Board Order No. R6T-2016-0038 (Marina General Permit).
The Lahontan Water Board’s Prosecution Team alleges that Tahoe Keys Marina is subject to $6,000 in mandatory minimum penalties for discharges of storm water to Lake Tahoe that exceeded effluent limitations found in the Marina General Permit. These violations took place on June 12, 2022.
Tahoe Keys SMI, LLC has agreed to settle the proposed penalty by (a) paying $6,000 to the State Water Pollution Cleanup and Abatement Account and (b) waiving its right to a public hearing. The Lahontan Water Board’s Prosecution Team has agreed to this proposal. The proposed settlement agreement is now available for a 30-day public comment period. The alleged violations and proposed settlement are described in more detail in the proposed settlement agreement, linked below. Comments are due by May 30, 2025 and may be submitted via email to RB6-Lahontan@waterboards.ca.gov.
