On July 1, 2016, the Water Board Prosecution Team issued Administrative Civil Liability Complaint No. R6V-2016-0042 (Complaint) to the City of Victorville (City) in response to alleged violations associated with six sanitary sewer overflow events and City sewer collection system planning, operations, and maintenance. The Water Board Prosecution Team and City subsequently entered into settlement negotiations, during which three additional sanitary sewer overflow events occurred. The Water Board Prosecution Team and City have entered into a tentative settlement agreement to resolve the violations alleged in the Complaint and associated with the three additional sanitary sewer overflow events.
The Water Board will be considering approval of the tentative settlement agreement through adopting the proposed Settlement Agreement and Stipulation for Entry of Order (Order) provided, below. The Order, if approved, will impose a total liability of $1,500,000 upon the City, $750,000 of which will be paid to the State Water Resources Control Board's Cleanup and Abatement Fund, and the remaining $750,000 being suspended upon the City completing its proposed Supplemental Environmental Project - Old Town Septic to Sewer Conversion Project. The Water Board is accepting written comments regarding the proposed Order through December 9, 2019. Additional information regarding the proposed Order and directions for submitting comments is provided in the Public Notice provided, below.
