Enforcement Actions for January 2009

The following is a summary of all enforcement actions taken or initiated during the month of January 2009. During this period the California Regional Water Quality Control Board, San Diego Region (Regional Board) initiated 9 enforcement actions: 1 Amended Complaint for Administrative Civil Liability; 1 Cleanup and Abatement Order; 2 Investigative Orders; 4 Notices of Violation; and 1 Staff Enforcement Letters.

ADMINISTRATIVE CIVIL LIABILITY COMPLAINTS

ACL Complaint No. R9-2008-0121, Amendment. Studio 15 Housing Partners, LLC, San Diego. Amended Complaint No. R9-2008-0121 in the amount of $42,000 was issued on January 5, 2009 to correct the number of alleged violations of NPDES Order No. R9-2000-0090 (discharges of extracted groundwater to San Diego Bay) that are subject to mandatory minimum penalties (MMPs) under Water Code Section 13385. The amended Complaint reduced the number of alleged violations subject to MMPs from 21 to 14 following further review of the data. The Discharger has waived its right to a hearing. The Regional Board will consider adopting a tentative ACL Order for $42,000 on February 11, 2009.

CLEANUP AND ABATEMENT ORDERS

Cleanup and Abatement Order No. R9-2009-0012. Former Carson Cleaners, Escondido. CAO Order No. R9-2009-0012 was issued on January 27, 2009 to investigate, cleanup and abate the effects of the unauthorized release of tetrachloroethylene (PCE) from the operation of a former dry cleaners on the site. The Order requires a baseline groundwater quality investigation report by April 30, 2009 and implementation of a site investigation and characterization workplan by July 28, 2009.

INVESTIGATIVE ORDERS

Investigative Order No. R9-2009-0015. Signet Armorlite Inc., San Marcos. IO No. R9-2009-0015 was issued on January 23, 2009 for unauthorized releases of chemicals to soil and groundwater at the Signet Armorlite, Inc. facility in San Marcos. The IO requires Signet Armorlite, Inc. to submit two technical reports to address data gaps in site characterization. A comprehensive soil and groundwater investigation workplan is required by February 28, 2009, and an investigation report with a proposed corrective action plan is due by May 30, 2009.

Investigative Order No. R9-2006-0140, Addendum No. 3. One Stop Auto Tech, Santee. Addendum No. 3 to IO No. R9-2006-0140 was issued on January 28, 2009 to extend the due date for a Corrective Action Plan to March 28, 2009 in order to allow time to complete the investigation and assessment needed to prepare an adequate plan. The IO was issued on October 31, 2006 for an investigation related to an unauthorized release of petroleum wastes from an underground storage tank system.

NOTICES OF VIOLATION (NOV)

NOV No. R9-2009-0011. Ramona Municipal Water District, San Vicente Wastewater Treatment Plant. NOV No. R9-2009-0011 was issued on January 2, 2009 for alleged violations of Order No. R9-1993-0003. Alleged violations include exceeding discharge specifications for total dissolved solids (TDS) and total coliform. NOV No. R9-2009-0013. Rancho California Water District, Santa Rosa Water Reclamation Facility, Temecula.

NOV No. R9-2009-0013 was issued on January 7, 2009 for alleged violations of Order No. R9-1994-0092. The NOV cited alleged violations for exceeded effluent discharge specifications for nitrate, TDS, and turbidity. In addition an alleged violation was cited for failing to provide a daily minimum chlorine contact time on one day.

NOV No. R9-2009-0010. Eastern Municipal Water District, Temecula Valley Regional Water Reclamation Facility. NOV No. R9-2009-0010 was issued on January 8, 2009 for alleged violations of Order NO. R9-2000-0165. Alleged violations include violations of effluent discharge specifications for iron, total coliform, and turbidity. Other alleged violations include failure to conduct required effluent monitoring and reporting for total suspended solids, volatile suspended solids, and biochemical oxygen demand. In addition, the NOV cites alleged failure to report concentrations of TDS in the potable water supply.

NOV No. R9-2009-0016. Mr. Terry One-Hour Cleaners, Escondido. NOV No. R9-2009-0016 was issued on January 23, 2009 for violation of Investigative Order No. R9-2008-0110. The alleged violation is for failing to submit a technical report that complied with the requirements of the Investigative Order. The Investigative Order was issued on October 9, 2008 to three parties to investigate effects of subsurface discharges of treatment agents used to remediate soil and groundwater contamination at the site. The parties submitted a report. However, the NOV alleges the report included 19 violations of requirements within the Investigative Order.

STAFF ENFORCEMENT LETTERS (SEL)

Trabuco Canyon Water District, Los Pinos Forestry Camp. An SEL was issued on January 8, 2009 for an alleged violation of WDR Order No. R9-1994-0046. The alleged violation was for influent flow that exceeded the maximum daily allowable limit.
