San Diego Region - Active Administrative Civil Liability Complaints
Below is a list of active administrative assessments of civil liability available for public comment.
- Notice of Written Comment Period for Tentative Settlement Agreement/Stipulated Order No. R9-2020-0028. On January 14, 2020, the California Regional Water Quality Control Board, San Diego Region (San Diego Water Board) released Tentative Settlement Agreement/Stipulated Order No. R9-2020-0028 for public review and comment. The San Diego Water Board is considering the adoption of Order No. R9-2020-0028 accepting OHL USA, Inc.'s payment of $741,466 to address liability associated with alleged violations of State Water Resources Control Board Order No. 2009-0009-DWQ, National Pollutant Discharge Elimination System Permit (NPDES) General Permit for Storm Water Discharges Associated with Construction and land Disturbance Activities, as amended. Tentative Order No. R9-2020-0028 and the Notice of Written Comment Period which contains instructions on how to submit written comments, are available using the links below. All written comments are due by 5:00 p.m. on Thursday, February 13, 2020. - ACL Complaint No. R9-2020-0006 – Baldwin & Sons, Inc. et al., Portola Center South Construction Site, Orange County. On January 10, 2020, the San Diego Water Board Prosecution Team issued ACL Complaint No. R9-2020-0006 against Baldwin and Sons, et al., in the amount of $9,115,932 for violations of the statewide general NPDES permit for construction storm water discharges. A hearing is tentatively scheduled for April 8, 2020.
