Land Disposal Program Activities

Under the legal authority of the California Water Code [CWC] Section 13260, the San Diego Water Board regulates discharges of wastes to land using permits known as "Waste Discharge Requirements" (WDR). The application for waste discharge requirements (WDRs) must be filed with the San Diego Water Board as a "report of waste discharge" [ROWD]. State regulatory requirements for management of hazardous wastes are found in the California Code of Regulations Title 23, Division 3, [CHAPTER 15]. The state requirements for management of non-hazardous wastes are found in the California Code of Regulations Title 27, Division 2, Subdivision 1 [TITLE27] [SWRCB JTD Index]. For active municipal solid waste landfills, the LDP staff also oversees regional compliance with the water quality requirements of the Federal regulations [CFR Title 40 Part 258] implementing Subtitle D of RCRA.

The Land Disposal Program (LDP) accomplishes its permitting responsibilities through the issuance of general WDRs, site specific WDRs, and waivers of WDRs. Old or existing deposits of wastes (e.g, burn ash sites, old municipal dumps, etc.) may also be regulated through the issuance of individual WDRs, general WDRs, or these sites may become the subject of San Diego Water Board enforcement actions (Orders) requiring cleanup and abatement.

The San Diego Region includes four Local Enforcement Agencies (LEAs) in the City of San Diego, San Diego County, Orange County, and Riverside County. The LDP staff coordinates with the LEAs to more effectively regulate discharges of nonhazardous wastes to land within the San Diego Region.
