Privacy Notice on Collection
Civil Code section 1798.17 requires a Privacy Notice on Collection to be provided when personal information is collected. Individuals have the right to review personal information maintained by State Water Resources Control Board and the Regional Water Quality Control Boards (Water Boards) unless access is exempted by law. You may review your records by contacting the official responsible for maintaining your information below. The State Water Resources Control Board (State Water Board) will not disclose your personal information unless authorized by law. Authority for Collection of Personal Information
The Water Boards collect personal information pursuant to the California Water Code Article 4, Chapter 4, Division 7 (commencing with 13260), Water Code Article, Chapter 3, Water Code Chapter 5.5, Division 7 (commencing with section 13370), Clean Water Act Section 402(p), the Federal Water Pollution Control Act (33 U.S.C. Sec. 1251 et. seq.), and the Code of Federal Regulations, 40 CFR 122.26; 40 CFR 122.22.
Principal Purpose for Which the Information Collected is to Be Used
The personal information collected through the WBKey User Account Registration Portal and the Stormwater Multiple Application and Report Tracking System (SMARTS) to create and manage user accounts, authenticate users, and provide access to SMARTS functions. The system supports obtaining permit coverage, as part of the National Pollutant Discharge Elimination System requirements, which allows the Water Boards to regulate and enforce permit requirements to protect water quality.
Known or Foreseeable Disclosures of the Information
We will not disclose your personal information unless authorized by law, required by law, or with your consent. Personal information may be disclosed to State and Regional Water Board staff for regulatory and administrative purposes, other governmental agencies as required for regulatory coordination or enforcement, and to the public as required under the California Public Records Act (Government Code section 7920.000 et seq.), except when exempt from disclosure.
Consequences of Not Providing Any or All Parts of the Requested Information
All information requested is mandatory unless marked as optional. Failure to provide required information will result in the inability to create a SMARTS account, and the inability to submit Notices of Intent, No Exposure Certifications, Erosivity Waivers, Report of Waste Discharges (e.g., permit coverage requests). Failure to submit requests for permit coverage may result in administrative or monetary enforcement action by the Regional Water Quality Control Boards or subject the entity to third-party lawsuits.
