Conditional Waivers of Waste Discharge Requirements for Low Threat Discharges

CONDITIONAL WAIVERS

The San Diego Water Board issued twelve classifications of waivers, for their respective thirty-six discharge types, through the adoption of Order No. R9-2014-0041, on June 26, 2014. In compliance with the provisions of the Water Code, these waivers are scheduled to expire on June 26, 2019, unless re-adopted by the San Diego Water Board.

In an effort to assist those Dischargers seeking to enroll in the waivers, the San Diego Water Board is providing

Waiver No. 1: Discharges from On-site Graywater Disposal Systems (On-site Graywater Disposal Waiver)

Waiver No. 2: Discharges to Land of Recycled Water (Recycled Water Waiver)

Waiver No. 3: Miscellaneous “Low Threat” Discharges to Land (Low Threat Discharge Waiver)

  • Discharges to Land of Air Conditioner Condensate and Non-Contact Cooling Water [NOI Required]
  • Discharges of Water to Land from Swimming Pools [NOI Required]
  • Discharges to Land from Construction and Test Pumping of Water Wells [NOI Required]
  • Discharges to Land from Short-Term Construction Dewatering Operations [NOI Required]
  • “Low Threat” Discharges to Land and/or Groundwater
    • Discharges to Land from Flushing Water Lines
    • Discharges to Land from Washing Vehicles, Pavement, Buildings, etc. [NOI Required]
    • Discharges to Land from Irrigated Lawns and Landscaping Using Groundwater or Municipal Supply Water
    • Discharges to Land from Structural Infiltration-based Best Management Practices
    • Discharges to Land of Groundwater from Foundation Drains, Crawl Space Pumps, and Footing Drains
    • Discharges to Land from Utility Vaults and Underground Structures to Land [NOI Required]

Waiver No. 4: Discharges of Winery Process Water to Lined Evaporation Ponds at Small Wineries (Winery Pond Waiver)

  • Discharges of Winery Process Water to Lined Evaporation Ponds at Small Wineries [NOI Required]
    **An annual fee will be required, once a fee schedule is adopted by the State Water Resources Control Board**

Waiver No. 5: Discharges of Wastes to Land at Composting Facilities (Composting Facilities Waiver)

  • Discharges of Wastes to Land at Composting Facilities [NOI and Compost Facility Certification Required]
    **An annual fee will be required, once a fee schedule is adopted by the State Water Resources Control Board**
    ***In development, State Water Resources Control Board Regulation of Compost Management Units***

Waiver No. 6: Discharges from Silvicultural Operations (Silvicultural Waiver)

  • Discharges of Storm Water Runoff
  • Discharges from Timber Harvesting Projects
  • Discharges from Wildfire Suppression and Fuels Management Activities

Waiver No. 7: Discharges from Animal Operations (Animal Operations Waiver)

  • Discharges from Small Animal Feeding Operations
  • Discharges from Medium Animal Feeding Operations [NOI Required]
    **An annual fee will be required, once a fee schedule is adopted by the State Water Resources Control Board**
  • Discharges of Storm Water Runoff
  • Discharge/Application of Manure to Soil as an Amendment or Mulch
  • Discharges from Grazing Lands
    ***In development, State Water Resources Control Board general waste discharge requirements for grazing lands***

Waiver No. 8: Discharges from Aquatic Animal Production Facilities (Aquatic Animal Facilities Waiver)

  • Discharges of wastewater from facilities producing less than 9,090 harvest weight kilograms per year of cold water aquatic animal species [NOI Required]
    **An annual fee will be required, once a fee schedule is adopted by the State Water Resources Control Board**
  • Discharges of wastewater from facilities which produce less than 45,454 harvest weight kilograms per year of warm water aquatic animal species [NOI Required]
    **An annual fee will be required, once a fee schedule is adopted by the State Water Resources Control Board**

Waiver No. 9: Discharges of Slurries to Land (Slurry Waiver)

  • Discharges of Drilling Muds to Land [NOI Required]
  • Discharges of Concrete Grinding Residues to Land [NOI Required]
  • Discharges of Slurries from Sand and Gravel Mining Operations to Land

Waiver No. 10: Discharges/Disposal of Solid Wastes to Land (Solid Waste Waiver)

  • Discharge/Application of Amendments and/or Mulches to Soil [NOI Required]
    **An annual fee will be required, once a fee schedule is adopted by the State Water Resources Control Board**
  • Discharges/Disposal of Inert Wastes to Solid Waste Disposal Facilities only Accepting Inert Wastes [NOI Required]
    **An annual fee will be required, once a fee schedule is adopted by the State Water Resources Control Board**
  • Discharges of Soils Containing Wastes to Temporary Waste Piles [NOI and Temporary Waste Pile Certification, Section A and Section B Required]
    **An annual fee will be required, once a fee schedule is adopted by the State Water Resources Control Board**
  • Discharge/Disposal/Reuse of Soils Characterized as Inert from Contaminated Sites to Land [NOI and Inert Waste Certification, Section A and Section B Required]
    **An annual fee will be required, once a fee schedule is adopted by the State Water Resources Control Board**

Waiver No. 11: Aerially Discharges Wastes Overland (Aerial Waste Waiver)

  • Discharges of Waste Related to Fireworks Displays Over Land [NOI Required]
  • Other Periodic Aerial Discharges of Wastes Over Land [NOI Required]

Waiver No. 12: Discharges of Emergency/Disaster Related Wastes (Emergency Waste Waiver)

  • Incidental Discharges of Oil and Oily Water within a Response Area During an Oil Spill Response in Marine Waters [NOI Required]
  • Discharges of Disaster Related Wastes to Temporary Waste Piles and Surface Impoundments [NOI Required]
  • Discharges of Mass Mortality Wastes to Temporary Waste Piles and Emergency Landfills [NOI Required]
  • Discharges of Dredge or Fill Material into Non-Federal Waters of the State, Under Emergency Conditions [NOI and Notice of Termination Required]
  • Emergency Repair and Protection Activities in Non-Federal Waters of the State [NOI Required]
  • Other Discharges of Emergency/Disaster Related Wastes [NOI Required]
